Top Torrent Sites Ranked by Google

BitTorrent’s popularity is growing every day. Despite the lawsuits that some of the larger torrent sites are involved in, they continue to grow traffic wise. Let’s take a look at how Google ranks the top torrent sites.

It is hard to make a definite list of the most popular BitTorrent sites. Over the years we’ve made quite a few lists, and reported some of the latest trends. Most lists we published were based on Alexa’s ranking, mainly because it was pretty much the only traffic source that was available. Recently, however, Google started to rank websites as well, including a traffic estimate.

So, let’s see how well Google does, and how their traffic estimation and ranking compares to actual traffic data and Alexa’s ranking respectively.

One of the interesting features of Google’s site comparison is that it gives an estimation of the daily traffic when you’re logged in on a Google account. The data used for the traffic statistics comes from Google analytics, consumer panels, and other third-party market research.

The traffic data seem to be quite accurate, for some sites at least. The daily (absolute) unique visitors for Mininova, for example, is estimated to be slightly above 2 million a day, which matches with real traffic stats we got from the Mininova team.

As we look at the graph below we can clearly see that Mininova is in the lead judging by the number of visitors, followed by The Pirate Bay. isoHunt and Torrentz compete for the third place. After these four sites there is a huge gap to other BitTorrent sites such as BTjunkie, TorrentReactor and TorrentPortal.

It is interesting to see how many similarities there are between Google’s ranking, and the daily reach according to Alexa.

The regional differences in popularity of the sites are also worth mentioning. The Pirate Bay, for example, is more popular than Mininova in the US, and especially in Sweden. Torrentz, on the other hand, does really well in India, while isoHunt has a relatively large fanbase in Japan.

Overall it seems that BitTorrent sites are still growing, especially The Pirate Bay, since they nearly doubled their traffic in a yeah. This is pretty much in line with the growth in the number of peers on The Pirate Bay trackers, which went from 5 to well over 10 million in the last 12 months.

TextBook Torrents Turns The Final Page and Closes Down

From relative obscurity, Textbook Torrents, the world’s largest BitTorrent index of textbooks, found itself in the world spotlight during July 2008 and was forced to close down by its host. The site returned weeks later, growing massively in the process, but now, just a couple of months on, the site has closed for good.

Quietly and with little fuss, January 2007 saw the birth of TextBook Torrents, a relatively small site initially, offering a BitTorrent tracker dedicated to the indexing of textbooks. In 6 months the site had accumulated 10,000 members. Just 3 months later, the number of users had doubled to 20,000 and by January 2008 the membership doubled again to an impressive 40,000. By the end of June 2008, almost 70,000 members were registered at TextBook Torrents and more and more people were becoming aware of its existence.

On July 1st 2008, Jeff Young, a writer with The Chronicle of Higher Education, wrote an article entitled Textbook Piracy Grows Online, Prompting a Counterattack From Publishers. The article focused on TextBook Torrents and it quickly gained traction after being picked up by Slashdot and subsequently, many other mainstream publications. In this explosion of publicity the site’s membership grew rapidly, but almost inevitably, the anti-piracy hawks began to circle.

Within days, Textbook Torrents’ host and domain registrar received takedown requests. At the time, Geekman, the admin of the tracker told TorrentFreak: “We received a DMCA notice from Pearson Education a week or so prior, which we complied with, but it was a group of publishers that contacted our host.” On July 5th Dreamhost suspended Geekman’s account and refused to speak with him and it took a week to even transfer the domain. It took a month for the site to return.

“I want to see the textbook industry change such that we are no longer needed,” Geekman told TorrentFreak when we asked him in early August about his motivation to bring back the site.

Now, just 2 months later, visitors to the TextBook Torrents site this week were faced with the grim reality that the site has gone. “TextBook Torrents won’t be coming back,” Geekman told TorrentFreak. “I’ve been at it for two years and it has been an awesome two years, but i’m ready to step back and hopefully allow somebody else to rise up in our place.”

Geekman told us that he felt that when it became clear to the copyright owners that simple threats to the site and its host wouldn’t be sufficient to close down the tracker, he himself became the next logical target: “We got word from several credible sources that there was a lawsuit in the works against myself personally,” he explained.

Of course, when anyone invests a huge amount of work into a project, there will be some pain to endure when it comes to an end, and Geekman is no different. “It does hurt. Textbook Torrents was my baby and one of my proudest projects, both personally and certainly as Geekman. At the same time, running the site had become very demanding. Since the attention last summer the site nearly doubled in size in 4 months from 60,000 to over 100,000 members. In all honesty, it was all I could do to keep up with media interview requests.”

Geekman told us that he was sorry to have to shut down the site without notice, but in the absence of others immediately stepping up to take over the running of the site, he had no alternative. He also said that he was disappointed that nobody stepped in with a replacement site when TextBook Torrents was down for 3 weeks in August, but hopes that someone will do so now.

When asked if book publishers have learned anything from the whole affair, Geekman said he doubted that: “Intellectual property corporations are notorious for missing the point. Like I’ve said before, we were out to make a statement, to give out as much free stuff as possible, and I think we’ve made that statement - perhaps not as loudly as we could have given another few months and a little more perseverance - but certainly people have heard, and are talking. Piracy will never be sustainable for the textbook industry, but perhaps this is the first step towards a more sustainable model in the future.”

When a torrent site goes offline, especially when it’s quite a quick shutdown, it’s inevitable that users get nervous that somehow they could be implicated if the site’s logs fall into the wrong hands. However, ex-users of the site have absolutely nothing to fear in this respect: “Textbook Torrents files, including logs and backups, have been permanently removed from all servers where they were stored,” notes Geekman, “We no longer have any data on the site or its users.”

All donations made to the site have been secured for the possibility of mounting a legal defense, should the need arise. However, once it’s established that Geekman is in the clear, whatever money is left over will be donated to a textbook or education-related non-profit organization. For his part, Geekman says he will ceremonially take the last $12 for himself, to cover the only thing he ever paid for on the site - the domain registration.

“I’m an activist, I’ll freely admit it but I believe activism is about a lot more than parading around holding a sign,” Geekman told TorrentFreak. “There are far more effective ways to get peoples’ attention.”

There can be no denying that TextBook Torrents did just that.

Gazelle Rejuvenates the BitTorrent Tracker Community

Some months back, Project Gazelle was launched. It was an attempt to build a new and improved BitTorrent tracker script. The ultimate goal is to produce a new framework for private torrent sites, faster than the common TB source, while being more secure from a code point of view, easier to modify, and more flexible.

TorrentFreak covered Gazelle at various points along its development. From inception, through beta testing, to its public début on What.cd, we’ve followed the development and progress. That progress has now lead to what could arguably be the most important day in any product’s lifecycle – initial release day.

Yes, all those nay-sayers and early fans that have populated the comment sections of our previous stories on Gazelle can finally prove what they’ve been claiming, as the first public release candidate of the script is now available for download.

Reactions from those that have given the site a try, have been mostly positive. The main negative comments stem from the fact it’s not an intuitive install. Part of that comes from the memory caching software – memcached – which gives the project its ‘blazing speed’. Also, right now the system uses XBTT as a tracker, but we’re told that it will have its own (multithreaded) tracker ready for later versions, codenamed ‘Ocelot’.

Also, as things stand, while they hoped for around a doubling of capacity over the older TBsource script, in practice it’s become more like double that, meaning a 10,000 user site under TBSource can probably handle 40,000 without any major difference in site response or system load. Project head WhatMan told TorrentFreak: “We out-shot our initial projections by a very wide margin.”

Interest in Project Gazelle has been fairly strong, and at least half a dozen sites are now running the new script. Perhaps more interestingly, though, is that Gazelle isn’t JUST a torrent site. Due to its modular nature, it can be used for regular sites as well. It’s a bit like a content management system in that respect, and perhaps our earlier comparison to Diferior wasn’t all that far from the mark.

If you’re interested in getting your hands on the Gazelle code, then just head over to the project site and follow the instructions. The whole kit-and-caboodle is released under a modified version of the GPL, so have fun.

Real-Time BitTorrent Search Engines Expand

‘Real-Time’ BitTorrent search engines are the trend of 2008, and new sites emerge every other week. It all started in January with the launch of YouTorrent, but soon after it went legal, other sites took over. We catch up with the founder of one of YouTorrent’s successors to find out more.

The “real-time” search approach YouTorrent introduced appealed to many users, and it is no surprise that most of the new meta-search engines that were inspired by it have been growing steadily. PizzaTorrent and NowTorrents serve hundreds and thousands of searches a day, and newcomers such as TorrentFly and the more basic looking Gpirate are picking up steam as well.

In March, we mentioned both PizzaTorrent and NowTorrents in our top 10 YouTorrent (meta-search) alternatives. Since then, a lot of things have changed, both in design and feature-wise. We decided to catch up with Godius, the founder of NowTorrents, to find out what’s happened since Spring.

“We recently re-coded and designed the whole website,” Godius told us. “The new site has a more user friendly layout and has a bunch of new features. For example it’s now possible to filter site-by-site results, filter keyword and categories, all in real-time. We also build a popular searches caching system, this has greatly improved loading times. And we added more personal search preference settings.”

One of the new features at NowTorrents (and Gpirate) is the BoxOffice listings. The MPAA probably won’t be too happy with such a feature, but the users love it according to Godius.

“We are planning to expand the BoxOffice torrents feature with a latest Games and Music Albums charts section. We have noticed that users greatly appreciate the BoxOffice section, so we feel that adding games and music charts will satisfy their needs even more. Many people don’t know what to search for; they just want to download the latest stuff that has just been released.”

BoxOffice torrents at NowTorrents

Godius is not too worried about the MPAA showing up at his doorstep, as he told us: “Basically we are doing exactly what Google is doing only we do not list non-torrent related results. We feel as long as Google gets away with it, and the torrent sites we link to get away with it, we have nothing to worry about.”

One of the downsides of all these new meta-torrent search engines is that they all rely on a handful of BitTorrent trackers, and sites that actually host torrent files. Running a meta-search engine is easier, less costly, and probably safer from a legal point of view. Nevertheless, they become useless if there are no torrent files to index, or torrents to track.

Private BitTorrent Trackers Under Threat From Major Exploit

Thousands of private BitTorrent trackers using the popular TBDev code are vulnerable to hostile takeover. According to a security researcher, a successful execution of the exploit could result in the attacker gaining admin rights to the tracker. However, knowledge and a little care can mitigate the effects.

The popular TBDev code on which thousands of private BitTorrent trackers are built, is said to be vulnerable to a major exploit. A successful attack could allow a malicious attacker to deface the main tracker page (index.php) and hijack the account of anyone who logs into the application. Worryingly it’s even possible to hijack an administrator’s account by using a social engineering attack to get them to click on specially crafted hyperlink, although most admins won’t be tricked by this method.

According to Michael Brooks, a security researcher who brought this issue to our attention, this particular TBDev exploit is down to the fact the developers didn’t protect the administrative interface from Cross Site Scripting attacks (XSS).

The attack uses CSRF in a chain with other flaws to obtain synergy - Michael calls this CSRF Bouncing.

“Unfortunately this Cross Site Scripting attack is accessible by an attacker using a Cross Site Request Forgery” Michael told TorrentFreak. “The Cross Site Scripting flaw is particularly valuable. The XSS payload is stored in the main index.php for the application. This means that an attacker can expose every visitor to their payload.”

Michael goes on: “The CSRF flaw is POST based so it does require the administrator to execute javascript. Finding the administrator account isn’t difficult if you have a user account on the system. Like with just about every SQL powered application the administrator is the first user account created. From this profile you will be able to send a personal message and you may even be able to obtain the admin’s email address.”

Worryingly, even if the attacker doesn’t have a user account, it’s possible to get one using an XSS flaw.

Michael explained how a malicious attacker increases his chances of a success with the exploit, by combining it with a little social engineering.

“In this case I am using the reflective XSS flaw to make it appear as though the administrator is viewing his own web application. The social engineering attack could look something like this: ‘I think there is a bug in your site. Can you check this link, it just does not look right http://localhost/redir.php?url=’ . This now means the flaw is no longer a “Cross Site” Request Forgery, because the request is being sent from the same website.”

After a successful attack it’s possible to deface the site and “hijack every user’s authentication token indefinitely”.

So what can be done to avoid this exploit? Michael told TorrentFreak:

“The most important thing to keep in mind is do not click on links that look like this. The link can be easily modified to be shorter, but the important part is avoiding links to TBDev’s /redir.php.”

“However this isn’t the only way that the flaw can be exploited. If you visit a website that the hacker controls then he can also trigger the attack. If you think you might have clicked on a bad link, change your password immediately.”

So what should an admin do if they already fell victim to the exploit?

“To remove the persistent XSS payload the administrator might have to login to the SQL server manually and delete the offending entry in the “news” table (since they won’t be able to use the web application to delete the news posting) using DELETE FROM news WHERE body LIKE ‘%fromCharCode%’.

The difficult part is that every user will have to change their password. In PHP I suggest defending against XSS using htmlspecialchars($var,ENT_QUOTES); . There are cases where XSS can still be possible without ENT_QUOTES. To defend against CSRF i suggest using PHP CSRF Guard.”

An administrator on a TBDev tracker we spoke with suggested a very quick fix off the top of his head:

in news.php change

$body = $_POST[”body”];

to

$body = htmlspecialchars($_POST[”body”],ENT_QUOTES);

We put this to Michael who told us: “The fix isn’t bad however the same fix also needs to be applied to $_GET[”url”] in redir.php or the administrator account as well as others are subjected to hijack. There are other security problems with this application, but the XSS is the most serious as it leads to immediate attack.”

Earlier today TorrentFreak contacted a number of admins with details of the exploit. Michael tells us he has notified the relevant people of the flaw but it may take a few days until an official patch is made available.

The full details of the exploit are available here.

Reports: Demonoid Blocking Countries

Whenever a popular torrent site goes down, it’s fairly normal for us to start receiving emails from users concerned about what’s happening, which then dry up fairly quickly after the site in question returns. Just recently we’ve been receiving a steady stream of emails asking why Demonoid is down which seemed strange because the site was operating normally each time we checked.

These sort of problem - when users in one geographical location can access a site when others can’t - is usually down to DNS issues which generally resolve themselves in a short time. However, in the case of Demonoid, this doesn’t appear to offer the answer.

According to reports we’ve received, when users from the Netherlands try to access Demonoid all they get is a blank white page. However, should they try to access the site using a proxy or VPN making the visitor appear they are not from the Netherlands, the user can now gain access. The block happens on all the major ISPs, and are persistent.

Canadians, having been previously blocked, remain unblocked, presumably after Demonoid fell out of range of the CRIA. However, more recently reports indicate that not only are Dutch users blocked from Demonoid, but in an unlikely scenario, Brazilians appear to be blocked too. So what could be at the bottom of this?

There could be some purely technical issues with the web, but as time goes on, this seems less and less likely. It’s possible that there is a legal angle to these blocks, after all this type of action by Demonoid isn’t new. Around 12 months ago Demonoid blocked Dutch users for a while, as the pressure from BREIN increased quietly behind the scenes, and then later on very publicly blocked millions of Canadians following pressure from the CRIA, only to unblock them again after moving to ’safer’ Ukraine-based hosting.

But, if Ukraine is ’safe’ as a host country, why block the Netherlands, and why block Brazil of all places? As it turns out there is a Demonoid/Brazil link, in that the Demonoid.com domain has a protected WHOIS provided by the Brazilian-based Neurocube.com, which in turn is hosted in the Netherlands at Demonoid’s old host, LeaseWeb. And of course, Netherlands-based anti-piracy group BREIN aren’t the biggest supporters of Demonoid either - and have lots of resources - but whether or not they still hold anything over the site in order to force a block of an entire country is a matter of speculation.

In the absence of any announcement from the new admin of Demonoid (which seems incredibly unlikely), it’s some users of Demonoid who asked us to find out why they can’t access the site. Unfortunately, we don’t have the answer for them right now, maybe they will become more clear in the future.

In the meantime, please keep us updated with access reports from your country and we’ll try to keep people updated on the position for Dutch and Brazilian Demonoid fans.

IsoHunt adds 10.000 Free and Legal Albums

When BitTorrent sites have come under attack by media groups and their battalions of lawyers, it’s usual for them to pull up the drawbridge and keep the site going as is, and try to get the case over with as soon as possible. The other option is to close down and hunt for a settlement, but isoHunt, like its other big-site brethren, hasn’t. Despite a legal campaign that’s now over two years old, it continues to grow and add features and functionality.

One of these new developments has been the addition of increasing numbers of Creative Commons (CC) licensed material. Creative Commons media is licensed by the creator, to be shared - usually with some restrictions - and is the same license used by TorrentFreak. It’s not a niche license, instead it is becoming increasingly popular, with Nine Inch Nails having released their Ghosts album under a CC license earlier this year.

With this is mind, isoHunt has announced a partnership with Jamendo, a site that deals in Creative Commons licensed music. Reaching the 10,000 album milestone only days ago, content available on Jamendo is growing quickly and when you grow, it helps to be able to get the content out there. This is why isoHunt decided to partner with several BitTorrent sites. isoHunt’s owner, Gary Fung, has been a long time supporter of Creative Commons and public domain works, and has stated that there is a strong future in Creative Commons material at isoHunt.

Laurent Kratz, CEO of Jamendo told TorrentFreak “Jamendo uses the Creative Commons licensing scheme to keep the rules very straight forward : copy as much as you can eat, the artist, the right-holders are ok. The new thing about partnering with a torrent portal like isoHunt, is that Jamendo has started an editorial work on top.”

“We receive up to 500 new albums per week, from more than 60 countries in the world,” Kratz said. “In order to maximize the interest of millions using torrent search engines every day, it was critical to only highlight a subset of all the albums we receive every day. It’s not about discriminating one band from another, it’s about getting anonymous BitTorrent fans to Jamendo, and discovering unsigned bands from everywhere in the world.”

Jamendo is also partnering with SumoTorrent, and torrent.to, and has been experimenting with mininova. In addition, their torrents are also available through Vuze. What better way to “stick it to the **AA” as so many of our commenters put it, than to ignore their memberships product, and use sites like this instead.

Download Torrents Remotely with Mininova Bookmarks

Mininova has just launched their new bookmarking feature for registered users. One of the benefits of your mininova bookmarks page is that generates a personalized RSS feed which allows you to automatically add bookmarked torrents to your BitTorrent client.

Importing torrents via RSS can be very useful if you’re at work, school, or at a friends place. With this new feature from mininova you only have to bookmark the torrent, and it will start downloading automatically when your BitTorrent client is running at home.

Here is how it works. First of all, you’ll have to be a registered user at Mininova to use the bookmarking feature. Then, when you come across a torrent you would like to download, simply click on the “Add to bookmarks” button. The torrent will then be added to your personal bookmarks page, which has its own RSS feed.

Next, you will have to add your personal bookmarks feed to your favorite BitTorrent client and then you’re all set. In addition you can customize the process a bit more, depending on the client you use. Some clients, for example, let you choose whether to download the torrent immediately, or start it later manually.

Mininova is not the first BitTorrent site to add bookmarking capabilities. Torrentz.com has had this feature for quite some time now. However, Mininova is the first site to combine it with an RSS feed that has BitTorrent enclosures, which makes it compatible with BitTorrent clients that support RSS downloading.

Mininova has covered their new bookmark feature, with some additional details, in their latest blog post. For those who are interested, we have some more RSS tutorials over here.

Torrentz Celebrates 5th Anniversary

Torrentz.com, the largest BitTorrent meta-search engine, celebrates its 5th anniversary today. The site, one of the oldest torrent sites around, has evolved quite a lot over the years. Let’s take a look at how it all started.

Back in 2003, torrent sites came and went like the wind. Since most sites were hosted on home connections or shared hosting accounts, they were struggling to stay online. And, with the MPAA keeping a close eye on every newcomer, legal pressure ended the aspirations of some webmasters.

Nonetheless, during July 2003 a new BitTorrent site by the name of “Torrentz” was launched. Initially, Torrentz was hosting torrent files, the opposite of its position today. The first torrent file - “X-Files [1x01] - Pilot” - was uploaded July 24, 2003, 1:28PM, exactly 5 years ago. Although the torrent file is no longer available the site is still going strong and the visitor count is growing every day.

Torrentz went live only a week after torrentse.cx, one of the largest BitTorrent sites at the time, chose to pull the plug. Like many others, torrentse.cx decided to shut down their site after they received a warning. At the time, one of the administrators stated: “The site torrentse.cx received a cease and desist letter during the day of Wednesday, July 16, 2003 for copyright infringement. The entire website has been removed and will not return.”

Another popular BitTorrent site, bytemonsoon.com, threw in the towel around the same time. “Due to excessive bandwidth usage, lack of a stable host, consistent dos attacks, and lack of other options and as I’m leaving in 5 hours and haven’t slept yet, I have no other choice but to shut the site down,” the admin wrote. Those were turbulent times, and SuprNova.org was pretty much the only large site left. However, the sites that went down were soon replaced and these new sites were growing fast - so did Torrentz.

The screenshot below was taken in August 2003, only two weeks after the site went public. As you can see, most torrents had only a handful of peers. Now, five years later, Torrentz has over a million visitors a day, while it indexes more than 10 million pages.

MPAA Hacker Spied on The Pirate Bay

Court documents show that a hacker, hired by the MPAA, offered to reveal the identities of the Pirate Bay founders. The hacker, who also retrieved private information from TorrentSpy, was paid $15.000 for his efforts.

It turns out that the MPAA will do pretty much anything to obtain information about BitTorrent sites and its users. Back in 2006, they made a deal with a “hacker”, better known as Robert Anderson, to steal e-mail correspondence and trade secrets from TorrentSpy.

The hacker later admitted that this was indeed true, and in a surprising turn of events, he switched sides, and joined TorrentSpy. The court case between the MPAA and TorrentSpy eventually led to the downfall of TorrentSpy, but it turned out that the MPAA was also interested in intel on The Pirate Bay.

Cnet cites court documents showing that Anderson wrote to the MPAA: “We can provide the names, address, and phone (numbers) of the owners of Torrentspy.com and Thepiratebay.org — along with evidence, including correspondence between the two companies.”

In addition, the court documents reveal that MPAA’s Dean Garfield stated: “We were going to get information about the location and identity of the people who were running Torrentspy, as well as information related to a general conspiracy and relationship between Torrentspy and a number of other prominent services including ThePirateBay.”

The Pirate Bay has always been one of the main targets of the MPAA. In 2006, John Malcolm, Executive Vice President of the MPAA wrote a letter to Sweden’s State Secretary in which he urged the authorities to take action against the site: “It is certainly not in Sweden’s best interests to earn a reputation among other nations and trading partners as a place where utter lawlessness with respect to intellectual property rights is tolerated.”

It is of course interesting to see that the MPAA is interested in the identities of the Pirate Bay founders, but they could have easily done a Google search, because that info is pretty much public information. I guess they rather use a hacker.

The Pirate Bay website is offline at the moment, unrelated to this news, as they are doing some server maintenance.

BitTorrent Mac Fans Try To Save the Coratee

Mac users missing the community spirit they enjoyed at BrokenStones are on an urgent mission to save an endangered manatee-like sea mammal which lives almost entirely on sea cabbage. But that will have to wait. There’s a brand new Gazelle-based Mac tracker in town - and it promises to be fun. We take a look.

For a commnunity more used to a certain calm, things have been quite turbulent in the Mac torrent scene recently. After hosting issues took down the BrokenStones tracker the mood was low. So, when another site, Vortex Network, offered much as a potential replacement but ultimately proved too controversial, the mood fell lower still.

What the community needs right now is less drama, a place to call home and some well-deserved fun. We spoke to a senior staffer at the brand new mac tracker, SaveTheCoratee.org, to get some answers on the important stuff - like what the hell a coratee is?

“A coratee is an animal that is similar to a manatee, its primary diet is sea cabbage” he told us. “It was hunted and killed by tuna companies and sold to you because they are easier to fish. They are slow and stupid animals that are loving and soft and on the brink of extinction, meaning they are in desperate need of saving.”

The BrokenStones community parallels are obvious - minus the “slow and stupid bit” perhaps. But, an equal (if not greater) amount of love, of course. And cabbage.

“We picked Save the Coratee because of two real reasons. One, I try to live my life and everything I do with a healthy sense of the ridiculous. Two, the mac community is a creative and innovative community. Hand them a fake animal with no description rather than ‘It’s kinda like a manatee’ and people love it. It builds community and creates a family feeling that is ‘fun’.”

So bizarre mammal protection aside, what inspired the staff to start the site? Our source told us: “When BrokenStones went down we started talking with people about getting a site up but Vortex beat us to it.” As we know, things didn’t go to plan at Vortex but in the background, slowly but surely, SaveTheCoratee was still in development. “We started talking and we were kinda moving slow, brain-storming etc. Then stuff started to go down hill at Vortex so we kicked it into gear,” the staff member said.

So, apart from all the regular categories and well-seeded torrents and cabbage-eating sea mammals one would expect at a site like this, what else is there to this site? Well, for a start, the site is based on the Project Gazelle codebase, but it’s been put together ‘in-house’. The team at What.cd weren’t involved beyond the initial development, although they did save the first coratee (a female), and managed to effect some sort of virgin birth and a successful breeding program. I didn’t pry any deeper.

Nevertheless, I was told that a big achievement during the development was that the coders managed to convert the music-based source of Gazelle into a multi-app, multi-purpose site in just 4 days, which certainly sounds like an achievement.

The staff member further told us that SaveTheCoratee hopes to develop into a small, dedicated group (5,000 members, maybe more) of users who love both Apple Computers and BitTorrent sites: “I never want the site to be big or to loose personality” he told us. The site currently has around 1000 members but it’s growing fast.

So what might convince potential users of the site to head over to their IRC channel with a big bucket of sea-cabbage bribes to smooth the entrance interview?

Our source told us: “We included a lot of…. how would I put this… win in the site……or love…….”

According to a message on the site, once you have loved a coratee, you cannot go back to a plain old manatee, because it will seem rough and stupid by comparison.

Sounds like a good time to stock up on sea-cabbage.

Textbook Torrents Makes Long Awaited Comeback

After a month of downtime, TextBookTorrents.com makes its return, right on time, as the first semester starts in just a few weeks. The BitTorrent tracker, dedicated to sharing knowledge in the form of textbooks, was pulled offline by Dreamhost early July because the hosting company received a takedown request.

The Textbook Torrents tracker is considered to be the largest library of textbooks on BitTorrent. The site had been flying under the radar for quite some time but this changed a month ago. On July 1st, The Chronicle of Higher Education ran a story on the site, which was picked up by Slashdot and later the LA Times blog.

All this attention led to thousands of new visitors to the tracker, but the publicity also had a downside. Geekman, the administrator of Textbook Torrents told TorrentFreak that their host, xlHost, and their domain registrar, Dreamhost, both received a takedown request a few days after all the press coverage. “We received a DMCA notice from Pearson Education a week or so prior, which we complied with, but it was a group of publishers that contacted our host,” he told us.

Although the tracker was pretty popular, with around 20,000 peers trading files at any given point in time, Geekman said he had never received takedown notices from big publishers before. “We had a couple of emails from individuals before, but nothing from organizations. One was an editor complaining about being cheated out of his 10¢ per copy commission.”

On July 5th Dreamhost suspended Geekman’s account, and despite his many efforts to contact them, they simply didn’t respond to his inquiries. It took more than a week before he was allowed to transfer the domain. Now, more than a month after the site went down, TextbookTorrents returns, and it’s not planning to go away anytime soon.

Geekman plans to focus on making the site’s resources redundant, to reduce vulnerability and to make sure the site remains online. In addition he will work on the legal issues and improve the privacy of the site’s users. One of the most drastic changes is the decision to stop the logging of IP-addresses, which means that the site will stop ratio tracking. Making the tracker public will ensure the privacy of the users, in case the server is compromised.

“I want to see the textbook industry change such that we are no longer needed,” Geekman says when we ask him about his main motivation to bring the site back, while mentioning cheap books and responsible business practices as examples of positive change.

He doesn’t think publishers should give away their books –even though some authors profit from doing so– but he does think most books are too expensive. “The companies may be corrupt, but they have a right to make money. They can’t be expected to give their material away for free. After all, there is a significant amount of work involved in the production of a textbook. We need a middle ground,” he says.

“I’m not naive enough to say that if something can be distributed in a digital form it should be free but there needs to be some adaptation here,” Geekman added. For now, however, all the publishers see is a threat to their revenue stream, as Allan Ryan of Harvard Business Publishing put it: “We have been fairly vigorous in monitoring these sites and in requesting that they take down our copyrighted content.”

They sure have something to monitor now, as TextbookTorrents has made its return…because you still can’t torrent beer. Currently, the site can only be accessed directly via the IP-address, however, the domain should be working again shortly.

TorrentIt Makes Long Awaited Comeback

TorrentIt is far from a newcomer in the BitTorrent community. The tracker has been around since 2004, but since it ran into the Duch anti-piracy lobbyists from BREIN, it has been offline. This weekend, however, the site officially relaunched, with help from their friends over at DigitalHive.

In BitTorrent terms, TorrentIt has quite a long history. The tracker started out in 2004 as 123Torrents. In early 2005, they lost the 123Torrents domain, and while negotiating to get it back, took on the domain torrentit.com. When negotiations failed, they decided to keep the TorrentIt name, and applied it to the newly created pirate theme for the site.

TorrentIt, which had 27,000 members at its peak, was known for having a large mix of scene and non-scene torrents, and for a very tight community. In April 2006, BREIN went after the original owner, who lived in the Netherlands, forcing the shutdown of the site under legal pressure. The TorrentIt crew decided it was better to take the site down than to have him take the heat, and took the site down.

Almost a year later in January 2007, some of the former staff members decided to bring the site back, under a new domain, one not attached to the original owner. The intention was to open by the end of May, but that never happened. The deadline was missed, and it took more than a year before the site was ready for its official relaunch.

BlastGT1, one of the original crew members, and an Admiral (equivalent to SysOp) at the new site told TorrentFreak: “Unfortunately, due to real life commitments, we missed that deadline, and after months of stagnation, I took it upon myself to find good coders within the torrent community who could help us finish the site, and try to repair the damage we had done to TiT’s good name.”

TorrentIt teamed up with the coders from DigitalHive, who were looking to start a new side project themselves, and this eventually led to the long awaited resurrection of the tracker. “Now, we’re back with a different domain, a different source and the drive to succeed,” BlastGT1 said.

“We don’t care about racing sites for pre times, we don’t care about having the biggest userbase. We care about having quality torrents, scene and non-scene, and most of all, we care about community. That is what made TorrentIt stand out before, and so many are already loving its return, finding their cabins kept warm and cozy,” BlastGT1 added.

The new and improved tracker changed its domain extension from .info to .eu, and now runs on Gazelle. Two days ago, they sent out almost 10K invites to former members, and many of them have joined the new site since. Unfortunately, an invite is needed to sign up, so not everybody will be able to celebrate and participate.

BlastGT1 has a word of advice for newcomers though: “Bide your time, get a good honest reputation elsewhere, have patience like people did once upon a time. Sooner or later you’ll make the right friend and snag an invite.”

The Pirate Bay Tops 15 Million Peers

Today, The Pirate Bay reached a new milestone, as they now have more than 3 million registered users. On top of that, they track close to 15 million unique peers. The largest BitTorrent tracker just keeps growing and growing, and there is no sign that this will be put to a halt anytime soon.

When this article is published, The Pirate Bay now tracks nearly 1,288,514 torrents and 14,786,539 unique peers. As a comparison, in December 2006 they tracked 576,080 torrents and 4,274,698 peers, so today’s figures represent quite an increase.

TiAMO, one of Pirate Bay’s co-founders and the one responsible for keeping the hardware up and running, is happy with the traffic increase, and writes:

“A big thanks to all our users helping to make the site what it is. We’ll keep growing for as long as you keep using the site, filing it with content, sharing.”

This traffic increase is apparently placing quite a lot of stress on their server park. In July, the site went offline for more than a day, as the server setup had trouble keeping up with the ever-growing demand. It is estimated that The Pirate Bay currently returns results to between 7 and 8 million searches per day, roughly 230 million a month.

The popularity of The Pirate Bay hasn’t gone unnoticed with artists either. Timbuktu, a well known Swedish rapper released his latest single exclusively on The Pirate Bay earlier today. Free of DRM, high quality and free to share and remix of course.

TorrentFreak’s Top 10 YouTorrent Alternatives

After YouTorrent decided that they were only interested in indexing a relatively tiny amount of licensed content from seven other sites, their links to content dropped dramatically. If the word on the BitTorrent streets is to be believed, their users are doing the same. But where will they go for their meta-searches?

When we announced that YouTorrent was launching, I don’t think we expected the site to grow in popularity as quickly as it did. A month after its launch the site was pulling in 2.5 million visitors and climbing - quickly. It even caught ‘Jon’ the owner of YouTorrent off guard, although he couldn’t have been that surprised after investing a considerable $20,000 to secure the YouTorrent.com domain. The site doesn’t even have adverts to finance itself. And is now up for sale. Hmmm. Surprises all round, then - and some.

“My goal is to be in the top 100 most-visited sites on the Internet in two years,” ‘Jon’ told BusinessWeek. “If I can corner the torrent market, everyone would rely on the site for profits, just as people look to Google for search-based advertising revenue.”

Yesterday, Patrick from YouTorrent told us: “The YouTorrent project has grown very quickly and unfortunately is not in line with the owning company’s core business.”

Unfortunately, the chances of becoming the BitTorrent equivalent of Google have evaporated. Having courted the file-sharing masses and gained huge amounts of free publicity as a result, the site is only now of interest to a tiny subset of them and it appears that for many, the site will never be useful again. So having just lost 99% of its original target market, it won’t be as much use to advertisers either. Wait….the site doesn’t have any ads……

This is getting confusing. Back to the matter in hand.

Top 10 YouTorrent (meta-search) Alternatives

1. PizzaTorrent

PizzaTorrent was the first YouTorrent clone, so it deserves to be top of the list.

2. NowTorrents

Another YouTorrent clone.

3. Torrentz

Fast, clean and reliable. Probably the best meta-search engine out there.

4. LookTorrent

A relatively new meta-search engine that presents search results in separate tabs

5. Torrents.to

Torrent.to uses a toolbar at the top of the page to search several BitTorrent sites.

6. Morrent

A meta-search engine with categories and advanced search operators.

7. Torrent-Finder

Searched more that 100 private and public BitTorrent sites, the results open in separate tabs.

8. TorrentScan

TorrentScan allows you to search 13 BitTorrent sites from one page.

9. BitDig

This could be a great site if they decided to got rid of the excessive advertising.

10. TorrentScoop

A meta serach engine powered by the Google coop service.

BitTorrent meta-search engines can be a great and easy way to find torrents. However, they are useless if all the sites they index host the same .torrent files. So, no matter how useful these site may seem, they are pretty much useless if there are no trackers.

Do you know any other new BitTorrent sites that are worth visiting? Leave a comment and share it with us…

YouTorrent Goes Legal, and Up For Sale

In just a matter of weeks since its launch, YouTorrent has become one of the most popular BitTorrent meta-search engines. This weekend, however, it revealed a shift in strategy and it now only indexes sites that host torrent files linking to “licensed” content.

Unsurprisingly, the enormous success of the site even inspired others to start similar projects. None of these came close to YouTorrent’s success, which now attracts over 10 million unique visitors a month.

YouTorrent’s selling points are the great interface, an ad-less design, and its ability to search most of the bigger BitTorrent sites. The latter has changed though, and this might very well be the end of YouTorrent’s popularity.

Patrick, one of the people running YouTorrent told TorrentFreak: “Due to the uncertain nature of the source and accuracy of the results returned by some engines, we have decided to reduce our engine selection to ones that claim the provision of licensed, certified content.”

It doesn’t stop there. YouTorrent is not only going ‘legal’, but Patrick is also looking into selling the site. “The YouTorrent project has grown very quickly and unfortunately is not in line with the owning companies core business,” Patrick said.

“We have had some interest [to buy] from some parties. On that basis, we have presented the site to other parties in the space to see if there is interest there also,” he added.

It is unfortunate to see that YouTorrent has to throw in the towel only 4 months after it launched. One thing is clear, they haven’t made any money so far, since there weren’t any ads on the site. Selling the site could make the YouTorrent team quite a few bucks though, it almost looks like this was the plan anyway.

Demonoid Is Back Online

Yesterday, we reported that the popular BitTorrent tracker Demonoid was to be resurrected, under a new administrator. Now, less that a day later the site has made its comeback after exactly 6 months of downtime.

A message posted on the Demonoid frontpage confirms that Deimos, the former administrator, left the Demonoid staff. The site seems to be working properly, as does the tracker, but there could be some downtime in the next few days. All the people who had an account at the time the site shut down can still sign in with the same username and password.

The resurrection of the popular BitTorrent traffic marks the end of a tough year for the site. The trouble for Demonoid started back in June last year, when the Dutch anti-piracy outfit BREIN started to put pressure on Demonoid and their ISP, Leaseweb. Deimos decided that the Netherlands wasn’t the safe haven it used to be and he to moved the site to Canada, which resulted in a few days of downtime.

Deimos never really told the administrators or members of the site exactly what was happening. Initially, most members assumed that there was some hardware failure, but after a few days it became clear that Demonoid was more or less forced to move. Maybe there could have been hardware failures too, who knows, but the outcome was the same - Canada here we come.

Relocating the servers to Canada initially solved the problems, but, by the end of September Deimos took Demonoid offline for the second time. Again, nobody knew what was going on until we found out that the CRIA was responsible for the downtime, which was later confirmed by Deimos. It turned out that Canada wasn’t the best choice after all.

After 5 days of downtime the site returned, now blocking all traffic from Canadian users in an attempt to calm down the CRIA. At first it looked like the storm was finally over, but on November 9th Demonoid’s users were welcomed by a disappointing message on the frontpage explaining that the CRIA was indeed responsible for the downtime.

The site never came back after November last year, up until now that is. Let’s hope it lasts this time.

BitTorrent Tracker Software “Gazelle” Debuts on What.cd

After a sneak peak and trial run last month, the what.cd team has finally made a semi-public release of the Gazelle tracker and site software, by doing its first large scale roll-out on its own site.

Gazelle, as we reported back in November, is an attempt by the group to replace the aging and buggy TBsource. It is intended as a fast, flexible system, that reduces load on servers and databases, whilst increasing features.

Over the weekend, what.cd was upgraded, so that all of its roughly 43,000 members could try it. Whilst there were initial bugs, including a problem with IRC channel password keys, everything seems to be running smoothly now.

More of a problem was a DDOS the site experienced when it had just gone live to its members. The attack which lasted over 4 hours and pulled 100Mb/sec, frustrated a number of the site’s users.

Also a source of frustration for many was a misunderstanding over a ‘freeleech’ offer. Done as a stress test, it was canceled after 6 hours – the announcement about it said it could last 24.

Many users who grabbed stuff they wouldn’t have gotten otherwise in an attempt to increase their ratio, started downloads and still had them going when it was stopped, which lead to some friction between staff and users. As always, the golden rule is to never download something you don’t want in an attempt to boost ratio.

However, Gazelle is not just for music trackers. Another site, Ntorrents, will be changing over to it shortly, according to an administrator there. This will be as much of a test in many ways for Gazelle as this weekend’s launch on what.cd was. This time though, it will be testing its viability beyond music trackers.

The developers have not yet announced a release date beyond ‘when all the major bugs are fixed’. Stay tuned for more.

The Pirate Bay Smashes 12,000,000 BitTorrent Users

It gets bigger. And bigger. And bigger - and more notorious. And more popular.

Today, The Pirate Bay announced that they have achieved an amazing 12,000,000 peers on the tracker, surpassing the previously-amazing 10,000,000 announcement just a short while ago.

Interestingly, and particularly so for fans of private trackers, brokep announced that since 2004, there has been a massive increase in the number of users actually seeding files, rather than just being regular peers. In 2004, around 20% of the tracker population were seeds and by 2005 this had increased to 25-30%. By 2006, the seeders had increased to an impressive 35% and 2007 saw further gains to 40%.

In 2008, the seeders amount to an impressive 50% of total tracker peers, further indication if it was needed that the desire to share clearly trumps the efforts of anti-piracy agencies.

Brokep of The Pirate Bay told TorrentFreak: “We have more seeders than leechers now. It was like 25% seeders 75% leechers [in 2004/2005], since then it’s gradually shifted over to 50/50″

But a measly 12,000,000 peers isn’t enough for the Pirate Bay crew. They want more - and more. And we end with a call out to the community from Brokep: “What we want you to do is to spread the word to your friends and make more people share files! Let’s break 15 million - and 20!”

It won’t be long in coming.

Create Your Own YouTorrent Clone in 1 Minute

When we announced that YouTorrent was launching, we did not expected the site to grow in popularity as quickly as it did. Only a month after its launch the site was pulling in 2.5 million visitors and climbing - quickly. In fact, YouTorrent became so popular that the site made it into the top 25 most visited BitTorrent sites only 2 months after its launch.

Unsurprisingly, other webmasters soon cloned the YouTorrent concept, and within a few weeks PizzaTorrent and NowTorrents saw the light, and even more clones followed. One of these clones is special though, as the code it offers is open source and available for free. The open source YouTorrent clone is named YouTorrent3 and has the same look and feel as the site it’s based on.

“In less than 1 minute you can have your own YouTorrent clone,” YouTorrent3 developer Aleksander told TorrentFreak. He explained that he decided to code it because he noticed that there was a growing interest for open source and easy to use YouTorrent clones.

It is extremely simple indeed, all you need to do is upload the files to your webserver and you’re good to go. It works fine, but the code can still be improved on, as Aleksander notes: “Don’t forget that work is coded in 1 hour, so don’t wonder why some code is strange or looks lame.”

At the moment only the frontend is available for download so people don’t need to install a database, and they can have their own YouTorrent clone online in a few seconds. Aleksander is still tweaking the backend to improve the caching system and make the database compatible with different SQL servers. The backend will be made public in a few weeks.

The source and instructions on how to get it working are available over here.

More and more authors seem to recognize the power of BitTorrent as a means to generate more sales, and actually upload free copies onto BitTorrent themselves.

Best selling author Paulo Coelho posted several of his books on BitTorrent, which boosted his sales significantly. The success of Coelho later inspired Leander Kahney, the author of “The Cult of Mac” and “The Cult of iPod”, to do the same.

A recent discussion on the positives and negatives of piracy confirms changing attitudes towards it. The “behind the scenes” thread on O’Reilly Radar was started by Eric Freeman, who wrote:

“Any thoughts on the rise of Head First titles (mostly HFDP and HTML) on Pirate Bay? I’m trying to just take it as a sign there is strong interest in the books still.”

The consensus among the authors who replied seems to be that having one’s book listed on BitTorrent sites is a good thing, and might actually generate more sales.

Nat Torkington wrote in a reply:

“So long as the royalty checks are strong, take BitTorrent as a sign of success rather than a problem. A wise dog doesn’t let his fleas bother him.”

Phil Torrone of Make magazine added:

“Yup - seeing your books / magazines on Pirate Bay is always a good thing.”

Piracy is less of a threat to book publishers than it is to the music industry though. As Nat Torkington notes, most people still prefer printed copies: “The HF books work really well as books, so at best the torrents act as advertisements for the superior print product.”

For music it’s different, as most people now prefer MP3s. The music that is offered on filesharing networks is superior to the DRMed alternatives that are available through music stores such as iTunes. The only option for the music industry is to adapt to the needs of their customers and start competing with pirates.

In related news, our very own Matt Mason just got his book “The Pirate’s Dilemma” leaked on BitTorrent. Matt announced that an official “free” version will be available for download later, but I’m sure that he doesn’t mind people sharing this pirated copy.

Mininova Downtime Puts BitTorrent Sites Under Pressure

Mininova’s Erik told TorrentFreak that there are problems with the network card of the loadbalancer, one of the parts they don’t have a backup for.

The mininova team is working hard to get the site up and running again. The good news is that no data will be lost, the bad news is that it may take a while - possibly 12 hours - because it is a holiday in The Netherlands.

Mininova’s forums are not connected to the loadbalancer, and are still up and running. The same is true for the seeds of their featured content section. Mininova currently has well over 3 million unique visitors per day, and more than 15 million pageviews, which makes them the BitTorrent site with the most traffic.

Consequently, the downtime at Mininova has resulted in quite a few extra visitors for several other BitTorrent sites. Flippy, the admin of Torrentz.com told TorrentFreak that he’s seeing a 50% traffic increase, which works out at tens of thousands of visitors an hour. As a result, Flippy has had a tough time keeping his site running smoothly, and other BitTorrent site admins are reporting similar traffic boosts.

For now Torrentz is doing fine, except for a few server connection issues every now and then. It’s a pretty scary thought that server issues at mininova can almost bring down the fourth largest BitTorrent site. A whole ring of BitTorrent sites could potentially collapse like a house of cards.

Mininova’s Traffic Doubles in a Year

To say that Mininova has grown quite a bit since it has started three years ago, is probably something of an understatement.

November last year saw Mininova breaking into Alexa’s list of the 50 most visited websites on the Internet, which is an amazing achievement in just 36 months . Close to 5 billion torrents have been downloaded already, and with the torrents, the numbers of visitors continues to grow.

Here is a comparison between Mininova’s traffic last month, and a year before that.

March 2007

57,605,816 visits
261,460,196 pageviews

March 2008

109,304,822 visits
530,181,594 pageviews

Mininova’s visitors literally come from all over the world, Google analytics even reports 63 visits from the Vatican and 12 from Antarctica. However, most of the visitors come from the United States, followed by the UK, France, Canada and Australia.

Other BitTorrent sites are seeing similar visitor boosts but in terms of traffic, Mininova is definitely leading the pack. TorrentFreak spoke with Niek, one of the founders of the site, and he sees opportunities to grow even further.

“We expect that Mininova will at least sustain its current number of visitors. As BitTorrent and P2P in general become more and more accepted by the general public, new users will find their way to Mininova and other torrent search engines,” says Niek. “What Google has done for the web, we try to accomplish for BitTorrent and P2P.”

As a result of the increased popularity, Mininova had to upgrade their hardware numerous times. Unfortunately the current setup still has some weak spots. Yesterday Mininova went down for over 12 hours due to hardware issues.

“The extensive downtime of the last few days was a result of very unfortunate accidents, namely a crashing hard disk and a failing network card of the load-balancer in combination with two successive holidays in The Netherlands. We will do our utmost to prevent such issues in the future,” Niek said.

We wish them all the best and will keep you informed when their traffic has doubled again.

OiNK’s Bail Date Extended Yet Again by Police

Cleveland police initially stated that the charges against Alan would be announced December 2007, but this was soon postponed for two months due to a lack of evidence. Interestingly, the police did return OiNK’s servers at the time, after they erased the hard drives. In February the bail date was extended for the second time, only to be extended yet again today.

TorrentFreak contacted Cleveland Police, but we were told that there was was no one available at the press office who could comment on the bail extension. Most likely, they need more time to gather evidence from the computers, laptop and mobile phones they still have in their possession.

OiNK was considered by many to be the finest BitTorrent music tracker the world has ever seen. The site tracked hundreds and thousands of torrents of the finest recordings, from virtually every musical genre. With millions of peers, it was more popular than most public trackers.

Jeremy Banks, Head of the IFPI’s Internet Anti-Piracy Unit described OiNK differently, and said the site was central to the illegal distribution of pre-release music online. “This was not a case of friends sharing music for pleasure. This was a worldwide network that got hold of music they did not own the rights to and posted it online,” he said.

Based on information from IFPI and others, Cleveland police claimed that OiNK was a money machine, and that Alan was making hundreds of thousands of pounds. The people who actually visited OiNK, however, know that the site was free to use. This was backed up by Trent Reznor, the frontman of Nine Inch Nails: “If OiNK cost anything, I would certainly have paid, but there isn’t the equivalent of that in the retail space right now.”

The IFPI and BPI did not only feed the police “misleading” information, they also took over the OiNK.cd domain and displayed an ominous message indicating an investigation into the site’s users had begun. These threats were intended to scare former OiNK members, and they succeeded in this until OiNK reclaimed the domain.

With the third extension in a row, the speculation about potential charges continues. At the moment it remains unclear what evidence the police are trying to find, but I assume they have figured out by now that the site is not as evil as the IFPI and BPI wanted them to believe.

isoHunt and MPAA Debate Legality of BitTorrent Sites

The isoHunt vs. MPAA case has been dragging on for more than two years now. It basically comes down to the question whether a BitTorrent site is facilitating copyright infringement by indexing .torrent files, that in some cases point to copyrighted material. An important question, and the answer is likely to set a precedent for future cases against similar sites.

In April, the appointed judge has asked both parties to clarify how BitTorrent works, and what isoHunt’s contribution is to the copying of (copyrighted) material. Little over a month ago the MPAA explained (in private) to judge Wilson why they think BitTorrent sites are infringing copyright, and today isoHunt has filed a response.

“The MPAA has taken a narrow point of view that copyright infringement is stealing, that isoHunt serves no other purpose than promoting and facilitating infringement of Hollywood films,” isoHunt owner Gary Fung writes. He and his lawyers refuse to be compared to “the bogeyman selling pirated DVDs on the street”, and explain why.

One of isoHunt’s arguments is that the site is in fact very similar to search engines like Google. They write: “The essential functions performed at a torrent site are also performed at a comprehensive search site like Google or Yahoo!. To visualize a visit to isoHunt, start off with a visit to Google – only a few things are changed, mostly superficial, and the workings are very similar.”

This is not a new argument, two years ago TorrentSpy used a similar analogy, and last year OiNK administrator Alan Ellis told The Telegraph: “If Google directed someone to a site they can illegally download music they are doing the same as what I have been accused of. I am not making any Oink users break the law.”

Indeed, torrent sites do not host or directly link to copyrighted content. In the filing isoHunt goes on explaining how BitTorrent works and what the role of the site is in the downloading process. They explain that all the site does is collecting and indexing metafiles (torrents), and that they are not directly involved in the downloading process.

The MPAA does not agree, and has argued that sites such as isoHunt offer a “centralized index” of copyrighted material. isoHunt, however, does not agree with this view, and tell judge Wilson: “It is a semantic game to argue that Defendants provide a “centralized index.” The words “centralized” and “central” are contrary to the principles that shape and define BitTorrent technology.”

BitTorrent is indeed decentralized rather than centralized, and the claim that BitTorrent sites are an “index of copyrighted material” is not correct either, since .torrent files itself are not copyrighted. Some files may link to copyrighted material (hosted on computers all over the world), but there are thousands of .torrent files that link to material that is uploaded with permission of the copyright holder.

isoHunt as a service does not infringe or facilitate copyright infringement, all they do is host .torrent files. These files may or may not point to copyrighted material, but this seems to be irrelevant. The site is not alone, hundreds of sites index .torrent files, and even Google has a .torrent search command. BitTorrent or .torrent links have nothing to do with copyright infringement, nor do sites like isoHunt.

“More innocent than Google, Defendants have no part in the design or operational control of the BitTorrent Network and have no more than a membership role,” isoHunt’s lawyers write. Perhaps the MPAA should due Google next?

To be continued…
