            <title>Pirate Bay Celebrates Microsoft’s Global Anti-Piracy Day</title>

            <description><![CDATA[<p>Today, Microsoft announced Global Anti-Piracy Day, to draw attention to the ever growing piracy problem. While Microsoft itself celebrates October 21st by launching anti-piracy enforcement actions in 49 countries, The Pirate Bay does so by linking to counterfeit Microsoft products on their frontpage - in every country in the world.</p>
<p><img src="http://torrentfreak.com/images/billtpb.jpg" align="right" alt="BillTPB" />To celebrate <a href="http://www.microsoft.com/presspass/press/2008/oct08/10-20GAPDPR.mspx?rss_fdn=Press%20Releases">Global Anti-Piracy Day</a>, <a href="http://thepiratebay.org">The Pirate Bay</a> has decided to replace their well known logo with the mugshot of Microsoft co-founder Bill Gates. Below the mugshot it reads &#8220;Bill Gates made me do it,&#8221; referring to his &#8216;criminal&#8217; history. </p>
<p>Although the company does send out DMCA takedown requests to BitTorrent site owners, Millions of Microsoft products are being pirated on BitTorrent and other filesharing networks every year.</p>
<p>Of course, Microsoft is doing all it can to prevent people from installing illegally obtained copies of their products, with their &#8216;<a href="http://en.wikipedia.org/wiki/Windows_Genuine_Advantage">Windows Genuine Advantage</a>&#8216; system as the flagship solution. Similar to most other anti-piracy measures, it also hurts honest customers, as it has a false positive rate of <a href="http://arstechnica.com/news.ars/post/20070124-8690.html">more than 20%</a>. The pirates will get what they want one way or another.</p>
<p>What Microsoft does not do, however, is sue individual downloaders. Unlike the RIAA they don&#8217;t think that the people who are potential customers are the right targets in their battle against piracy. Instead, they mostly target resellers who sell illicit copies of their products. &#8220;Legitimate businesses struggle to compete against these illegal resellers who undercut their prices and contribute to the 20 percent software piracy rate in the U.S.,&#8221; the company states.</p>
<p>The Pirate Bay has no commercial interests, but contrary to what Microsoft would have hoped for, they are <a href="http://thepiratebay.org/legal">not very responsive</a> to letters from Microsoft either. In addition, we seriously doubt that &#8216;Global Anti-Piracy Day&#8217; is the success they want it to be, now Bill Gates&#8217; is on the frontpage of the largest BitTorrent tracker on the Internet.</p>

            <title>Pirate Bay Tricks Anti-Pirates with Fake Peers</title>

            <description><![CDATA[<p>The Pirate Bay has always made it clear that they don&#8217;t obey takedown requests from content owners. That doesn&#8217;t stop Hollywood from going after the Pirate Bay&#8217;s users, however, and they do so on a large scale. The Pirate Bay is well aware of these pirate tracking outfits, and does what it can to give them a hard time. Reporting fake peers is one of the tricks they use.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay" />Most often, companies such as <a href="http://www.baytsp.com/">BayTSP</a> and <a href="http://www.mediasentry.com/">MediaSentry</a> are hired to connect to BitTorrent trackers, and send takedown notices to the users (via their ISP) who download movies, TV-shows or music albums of a company they represent. This is a fairly easy process, since BitTorrent is far from anonymous: Every user necessarily broadcasts his or her IP-address to other peers in the swarm. </p>
<p>Sometimes anti-piracy outfits use their own trackers to gather evidence. Last week <a href="http://torrentfreak.com/the-pirate-bay-removes-fake-trackers-from-torrents-081016/">we reported</a> that The Pirate Bay started to actively remove these suspicious trackers from their torrents, with some help from <a href="http://torrenteditor.com">torrenteditor.com</a>. Running a tracker is not required though, to collect information from BitTorrent users. In fact, many attempt to use publicly available trackers such as The Pirate Bay to do so. However, the tracker owners are aware of this, and trick these tracking companies by polluting the list of IP-addresses the tracker returns. That is one of the techniques The Pirate Bay uses, just to show how flawed the evidence gathering is.</p>
<p>Polluting the evidence works like this. When a client asks for a list of peers who are downloading the same torrent, the tracker software automatically inserts several &#8220;random IP addresses&#8221; that are not in the swarm. They are based on existing sub-nets, but might be from people who may not even be aware that BitTorrent exists. This means that the evidence that&#8217;s being gathered by anti-piracy companies includes IPs that belong to people that were not downloading the movie or album they are accused of. Perfect deniability, as the people who coded the tracker software <a href="http://opentracker.blog.h3q.com/?p=22">explain</a>.</p>
<p>Of course, this doesn&#8217;t work when the pirate-tracking company requires itself to connect to the peer, before the IP-address is collected, since it is impossible to connect to a non-existing peer. A representative from BayTSP told TorrentFreak that they have such a requirement, but several others are <a href="http://torrentfreak.com/study-reveals-reckless-anti-piracy-antics-080605/">less thorough</a>, which makes their claims useless, and impossible to defend in court.</p>
<p>The best solution is of course to ban these anti-piracy companies from using the tracker in the first place. This is something The Pirate Bay is working on as well, and they have blocked many IP-ranges already, but it&#8217;s impossible to ban them all. Unlike most of the suits in Hollywood, the companies that go after illicit file-sharers are experts in their field, and know more about BitTorrent than many users. They try to circumvent blocklists such as PeerGuardian whenever possible, and change IPs when they are marked. </p>
<p><a href="http://thepiratebay.org">Pirate Bay</a> co-founder TiAMO told TorrentFreak that he has several criteria on which he can pick out the suspicious users that might be collecting IP-addresses. He also said that he&#8217;s working on a automated warning system which will operate as a sniffer on a monitor port. That project is far from complete, but has the potential to detect suspicious behavior more easily.</p>
<p>Nevertheless, it is impossible (as the name might give away) to keep the prying eyes of Hollywood off public trackers. Even private trackers are far from secure, as most anti-piracy companies have accounts at the larger communities. The private in &#8220;private tracker&#8221; merely refers to the fact that you have to login, and has nothing to do with &#8220;security&#8221;. The Pirate Bay (and other tracker owners) take several measures to prevent their users from being tracked by anti-piracy outfits, but there&#8217;s only so much they can do.</p>

            <title>The Pirate Bay Removes Fake Trackers from Torrents</title>

            <description><![CDATA[<p>In an attempt to make BitTorrent more secure, and to reduce some of the load on their own tracker, The Pirate Bay has started to remove all duplicate, dead and anti-pirate trackers from the torrents they host. These changes will improve the trackers&#8217; performance, and increase &#8217;security&#8217; for its users.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay" />Running the largest BitTorrent tracker on the Internet requires a lot of expensive hardware. To keep this hardware running smoothly, <a href="http://thepiratebay.org">The Pirate Bay</a> is constantly optimizing their setup.</p>
<p>One of the latest changes is that they have started to automatically remove duplicate trackers from torrent files, to keep unnecessary connections between BitTorrent clients and their <a href="http://torrentfreak.com/the-pirate-bay-switches-to-opentracker-071208">tracker</a> to a minimum. </p>
<p>Pirate Bay co-founder TiAMO explained to TorrentFreak: &#8220;It&#8217;s totally unnecessary to have more than one of our tracker URLs when they all have the same peers, they just ask the tracker for the same data lots of times.&#8221;</p>
<p>&#8220;Also, now we can strip out all bad trackers from anti-p2p companies, as well as old ones that stopped working years ago,&#8221; he added. So, while they were at it, they have also decided to remove dead trackers, and BitTorrent trackers that are run by anti-piracy organizations. This makes it less likely that the MPAA and RIAA , often though companies like <a href="http://en.wikipedia.org/wiki/MediaSentry">Mediasentry</a>, can keep tabs on the download habits of Pirate Bay users.</p>
<p>Another advantage, of course, is that the number of <a href="http://torrentfreak.com/mpaa-caught-uploading-fake-torrents/">fake files and spam</a> from companies such as MediaDefender are kept to a minimum. Fake torrents are often used to trick people into downloading useless data instead of Hollywood&#8217;s latest blockbuster. The Pirate Bay already had quite a <a href="http://torrentfreak.com/mediadefender-decoy-effectiveness-on-bittorrent-sites-070922/">good track record</a> when it comes to removing fakes, and this will only improve with these latest changes. </p>
<p>The Pirate Bay currently has <a href="http://static.thepiratebay.org/">13 servers</a> dedicated to the tracker, and another 14 servers for the website itself. Yesterday, the tracker broke a new record, with close to 18 million active users on &#8220;<a href="http://torrentfreak.com/heroes-causes-bittorrent-boom-080924/">TV-torrent Tuesday</a>&#8220;, and at the current rate, they will be tracking 20 million peers a few weeks from now.</p>

            <title>Court Deems Pirate Bay Block to be Illegal</title>

            <description><![CDATA[<p>This August The Pirate Bay was “censored” in Italy following a decree from a public prosecutor. The Pirate Bay appealed the block and eventually won the court case. Earlier this week the Court of Bergamo detailed its decision, and ruled that no foreign website can be censored for alleged copyright infringement.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay" />Two months ago, following <a href="http://torrentfreak.com/the-pirate-bay-blocked-in-italy-080809/">an order</a> from an Italian prosecutor, ISPs started to prevent their customers from accessing the Pirate Bay. The administrators of the popular BitTorrent tracker were accused of making copyrighted material available on the Internet for commercial purposes.</p>
<p>Of course, the Pirate Bay team didn&#8217;t agree, and responded in true Pirate Bay style. &#8220;We&#8217;re quite used to fascist countries not allowing freedom of speech. A lot of smaller nations that have dictators decide to block our site since we can help spread information that could be harmful to the dictators,&#8221; <a href="http://thepiratebay.org/blog/123">Sunde wrote</a> in a blog entry.</p>
<p>The BitTorrent tracker was not going down without a fight, and later announced that it would <a href="http://torrentfreak.com/the-pirate-bay-to-appeal-italian-blockade-080820/">appeal the decision</a> in court, which they won. The <a href="http://torrentfreak.com/pirate-bay-wins-court-case-italian-block-lifted-080925/">block was lifted</a> and ISPs could again grant their users access to the most frequently used BitTorrent tracker on the Internet. </p>
<p>The Court of Bergamo decided that this block was unlawful, and earlier this week they explained why. According to the court statement (<a href="http://www.giuristitelematici.it/modules/bdnews/article.php?storyid=1520">Italian</a>), no criminal court is allowed to issue an order to ISPs to block traffic to a foreign website, based on alleged copyright infringement. Italian law implements an European Directive, 2000/31 CE, which this means that this ruling should be valid in other European countries as well.</p>
<p>&#8220;Under Italian law, this is possible only for child porn and for unauthorized gambling, but there is no such provision for copyright infringement,&#8221; Pirate Bay&#8217;s lawyers Giovanni Battista Gallus and Francesco Micozzi explained to TorrentFreak.</p>
<p>&#8220;We have to make sure that no legislative bill promoting such filtering provisions will be passed in the future. At the European level, many authorities pointed out the need to find a balance between the enforcement of alleged copyright infringements, users&#8217; rights, and privacy issues.&#8221;</p>
<p>In hindsight, the block only helped the Pirate Bay to grow even further. The case generated a lot of free promotion, and the number of visitors from Italy increased by <a href="http://torrentfreak.com/the-pirate-bay-sees-boost-in-italian-traffic-following-block-080815/">5 percent</a>. Not exactly the outcome IFPI had hoped for.</p>

            <title>News Site Criticized for Linking to Pirate Bay Torrents</title>

            <description><![CDATA[<p>The Swedish news site Nyheter24 has been criticized for including a list of most downloaded TV-shows on their site, and linking directly to the torrent detail pages on The Pirate Bay. According to Henrik Pontén of the Swedish Anti Pirate Bureau, who led the Pirate Bay investigation, the news site is assisting copyright infringement.</p>
<p><img src="http://torrentfreak.com/images/tpb-download-chart.jpg" align="right" alt="download " />Earlier this week, Swedish news site <a href="http://nyheter24.se/">Nyheter24</a> was launched. Backed by big investors, it aims to challenge the established newspapers online and appeal to a young readership with quick reporting. </p>
<p>Of course, since young readers are used to downloading the TV shows they want to watch, it was natural for Nyheter24 to include not only a top-list of conventional audience ratings on their <a href="http://nyheter24.se/vadertv/tv/">TV schedules page</a>, but also the top-list of most downloaded TV shows at The Pirate Bay. In addition, the site decided to link the entries in the top-list entries to the respective TV show&#8217;s torrent page on The Pirate Bay.</p>
<p>This didn&#8217;t fall too well with Henrik Pontén of the Swedish Anti Pirate Bureau. Pontén gathered fame earlier for manufacturing evidence against The Pirate Bay before the <a href="http://torrentfreak.com/the-companies-behind-the-piratebay-raid/">controversial raid</a>, and spearheading the copyright lobby as charges were filed against the tracker in January.</p>
<p>&#8220;We consider this being &#8216;assisting copyright infringement&#8217;, just like The Pirate Bay itself. I assume this is a mistake and that they will remove the links,&#8221; he told <a href="http://www.realtid.se/ArticlePages/200810/02/20081002153801_Realtid575/20081002153801_Realtid575.dbp.asp">Realtid.se</a>. The story didn&#8217;t discuss if sites that are linking to Nyheter24.se (or sites that link to sites that link to Nyheter24.se) are also considered to be assisting in copyright infringement by Pontén.</p>
<p>Nyheter24 replied to Pontén&#8217;s accusations, and said that the The Pirate Bay admins have not yet been convicted of anything illegal, and that removal of the links only become matter of discussion if they, against all odds, will be. Hours later, however, Nyheter24 revised its position and removed the direct links to the torrent pages. The site kept the top-list on their TV schedules page, with a link to The Pirate Bay&#8217;s front page instead.</p>
<p>&#8220;We are removing the direct links since they may be illegal and it&#8217;s not our intention to challenge copyright law. However, half of the Swedish population downloads from the net and I&#8217;d love to have a partnership with The Pirate Bay,&#8221; <a href="http://www.realtid.se/ArticlePages/200810/03/20081003093802_Realtid603/20081003093802_Realtid603.dbp.asp">said</a> Douglas Roos, chairman of the Nyheter24 board.</p>
<p>If Henrik Pontén decides to pursue the matter, and file charges against Nyheter24 on the same basis as he went for The Pirate Bay, he will have a familiar face to battle in court. Nyheter24&#8217;s legal representative is none other than Monique Wadstedt, better known as the MPA&#8217;s judicial representative in Sweden and Pontén&#8217;s sidekick in their Don Quijote quest against The Pirate Bay.</p>
<p>&#8220;These boys will go to jail,&#8221; she said in January when charges were filed against The Pirate Bay. &#8220;I have no comments. I won&#8217;t answer further questions,&#8221; she <a href="http://www.realtid.se/ArticlePages/200810/03/20081003121154_Realtid494/20081003121154_Realtid494.dbp.asp">said on Friday</a> when asked for a comment about the criticism from her partner Henrik Pontén about her other partner Nyheter24.</p>

            <title>The Pirate Bay Clashes with Book Publishers</title>

            <description><![CDATA[<p>Swedish book publishers have presented a study in which they show how widespread book piracy is in Sweden. The publishers think that this copyright infringement has a disastrous effect on their income, while The Pirate Bay is surprised to see that the publishers used their torrent database illegally.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay" />The Swedish book publishers organization recently issued <a href="http://thepiratebay.org/torrent/4419351/Ljudb__cker_och_e-b__cker_p___The_Pirate_Bay._En_kartl__ggning_a">a report</a> in which they revealed that 85% of the best-selling books in Sweden are available on The Pirate Bay. Not really shocking news, Pirate Bay co-founder Peter Sunde told TorrentFreak he&#8217;s actually &#8220;a bit sad that it&#8217;s not 100%.&#8221;</p>
<p>Perhaps of more interest is the technique used by the publishers&#8217; organization to gather their data. In the report they write that they had to code a specialized tool to scrape the Pirate Bay database for book titles, since there were no ready-made tools available. </p>
<p>Peter Sunde is now arguing that they were breaking the law by scraping the site multiple times without permission. &#8220;The Pirate Bay actually owns the copyright to its own database of torrents,&#8221; Sunde <a href="http://blog.brokep.com/2008/09/29/tpb-utsatt-for-upphovsrattsintrang/">writes on his blog</a>. Sunde further refers to the Pirate Bay&#8217;s <a href="http://thepiratebay.org/policy">Usage Policy</a>, which the book publishers organization has violated. </p>
<p>In true MPAA style, Sunde is determined to fight for his intellectual property. &#8220;I called them up and asked them to present more information about the technical things, so we can send them an invoice if they don&#8217;t want to be dragged into court,&#8221; Sunde told TorrentFreak in a comment. </p>
<p>Meanwhile, the true reason behind the real book publishers&#8217; study remains vague. As we&#8217;ve pointed out many times before, piracy can actually boost book sales. One of the prime examples is best-selling author Paulo Coelho, who said he sold thousands of extra copies because he <a href="http://torrentfreak.com/alchemist-author-pirates-own-books-080124/">pirated his own books</a>. Coelho&#8217;s success later inspired the publisher and Leander Kahney - the author of the two books - <a href="http://cultofmac.com/free-copies-of-cult-of-mac-and-cult-of-ipod-on-filesharing-networks/1845">to do the same</a>, with several others following this example. Particularly for book authors, piracy seems to be a useful promotional tool, rather than a threat. For now, that is.</p>
<p>We can&#8217;t foresee what will happen if <a href="http://blog.wired.com/business/2008/09/pirate-bay-co-f.html">someone</a> launches a <a href="http://en.wikipedia.org/wiki/Kindle">Kindle</a> ready pirate site. More on this later, for sure.</p>

            <title>Pirate Bay Wins Court Case, Italian Block Lifted</title>

            <description><![CDATA[<p>The Pirate Bay has successfully appealed the decision of an Italian judge who had ordered ISPs to block access to the popular BitTorrent tracker last month. The Court of Bergamo decided that this block was unlawful, and that Italian users should regain access to the site.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay" />This August, out of nowhere, The Pirate Bay was “<a href="http://torrentfreak.com/the-pirate-bay-blocked-in-italy-080809/">censored</a>” in Italy following a decree from a public prosecutor. The block didn’t prove to be particularly effective, as traffic from Italy only increased. Nevertheless, The Pirate Bay was determined to reverse the decision, and in that mission they have succeeded.</p>
<p>The Court of Bergamo has now lifted the block, and ISPs are again allowed to grant their users access to the most frequently used BitTorrent tracker on the Internet. More details on the decision, and the reason why the block was reversed, will be made public later.</p>
<p>In a previous interview, Pirate Bay’s lawyers Giovanni Battista Gallus and Francesco Micozzi <a href="http://torrentfreak.com/the-pirate-bay-to-appeal-italian-blockade-080820/">described</a> the order as &#8220;‘original’ or ‘creative’ at best,” and said it should not have been ordered in the first place because of the lack of jurisdiction. In addition, they argued that The Pirate Bay is not breaking any laws since it&#8217;s not distributing copyright infringing material.</p>
<p>The court&#8217;s decision might set an important precedent for BitTorrent sites in Italy, especially for <a href="http://www.slyck.com/story1725_ColomboBT_Shut_down">Colombo-BT</a>, the largest Italian torrent site, which was shut down by the same prosecutor responsible for the Pirate Bay block. The action against Colombo-BT was orchestrated by the anti-piracy outlet IFPI, which also <a href="http://torrentfreak.com/ifpi-hijacks-pirate-bay-traffic-080815/">hijacked</a> all Italian Pirate Bay visitors following the block.</p>

            <description><![CDATA[<p>Today, The Pirate Bay reached a new milestone, as they now have more than 3 million registered users. On top of that, they track close to 15 million unique peers. The largest BitTorrent tracker just keeps growing and growing, and there is no sign that this will be put to a halt anytime soon.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay" />When this article is published, <a href="http://thepiratebay.org">The Pirate Bay</a> now tracks nearly 1,288,514 torrents and 14,786,539 unique peers. As a comparison, in December 2006 they tracked 576,080 torrents and 4,274,698 peers, so today&#8217;s figures represent quite an increase.</p>
<p>TiAMO, one of Pirate Bay&#8217;s co-founders and the one responsible for keeping the hardware up and running, is happy with the traffic increase, and <a href="http://thepiratebay.org/blog/133">writes</a>: </p>
<p>&#8220;A big thanks to all our users helping to make the site what it is. We&#8217;ll keep growing for as long as you keep using the site, filing it with content, sharing.&#8221;</p>
<p>This traffic increase is apparently placing quite a lot of stress on their server park. In July, the site went offline for more than a day, as the server setup had <a href="http://torrentfreak.com/pirate-bay-facing-server-troubles-and-downtime-080729/">trouble </a>keeping up with the ever-growing demand. It is estimated that The Pirate Bay currently returns results to between 7 and 8 million searches per day, roughly 230 million a month. </p>
<p>The popularity of The Pirate Bay hasn&#8217;t gone unnoticed with artists either. Timbuktu, a well known Swedish rapper released his latest single <a href="http://thepiratebay.org/special/timtack.php">exclusively</a> on The Pirate Bay earlier today. Free of DRM, high quality and free to share and remix of course.</p>

            <description><![CDATA[<p>The Pirate Bay, Mininova and isoHunt all have millions of visitors every day, searching for music, movies, software and especially TV-shows. Together, the three BitTorrent sites serve an impressive 500 million searches each month, and this number is going up every month.</p>
<p><a href="http://thepiratebay.org">The Pirate Bay</a>, <a href="http://mininova.org">Mininova</a> and <a href="http://isohunt.com">isoHunt</a> combined achieve over a billion pageviews a month. These are quite remarkable statistics when you consider that together, the trio run on less than 100 servers (cf. Facebook has <a href="http://www.datacenterknowledge.com/archives/2008/04/23/facebook-now-running-10000-web-servers">10,000</a>).</p>
<p>Despite all three sites being involved in lawsuits, they continue to attract more visitors, and thus more searches. Mininova and The Pirate Bay currently process between 7 and 8 million searches per day, roughly 230 million a month. isoHunt isn&#8217;t far behind though, as its users perform 6 million searches every day, totaling some 180 million a month.</p>
<p>As <a href="http://www.slyck.com/news.php?story=1754">Slyck points out</a> today, the larger BitTorrent sites are getting as many searches as eBay and Amazon. When combined, the three BitTorrent sites are good for half a billion searches every month, which equals half of MSN&#8217;s total search traffic (and 5% of Google&#8217;s searches). The major difference though, is that the BitTorrent sites are still growing, while Microsoft&#8217;s search engine traffic is declining.</p>
<p>Even though most people use BitTorrent to <a href="http://torrentfreak.com/50-percent-bittorrent-downloads-tv-080214/">download TV-shows</a>, the latest Hollywood blockbusters such as Wall-E and The Dark Knight can also be found among the most popular searches. An interesting trend worth mentioning is that more people are searching for high definition content, as &#8216;<a href="http://en.wikipedia.org/wiki/720p">720p</a>&#8216; is a recurring term in most site search clouds.</p>

            <description><![CDATA[<p>The upcoming trial against ‘The Pirate Bay Four’ has been delayed and at its earliest will begin at the end of this year - maybe even next year. Stockholm District Court initially said that the trial would start by the end of the summer, but gathering damage claims and serving summons took longer than expected.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay" />After a two year investigation into The Pirate Bay, Swedish authorities <a href="http://torrentfreak.com/pirate-bay-team-charged-080131/">filed charges</a> against four people. Now, eight months later, there is still no date set for the trial.</p>
<p>&#8220;The process has taken a lot of time. First, it took time serving judicial summons to the defendants and then we had to gather damage claims from the complainants,&#8221; Anita Thimberg, a clerk at the Stockholm District Court, <a href="http://www.dn.se/DNet/jsp/polopoly.jsp?d=3130&amp;a=821488">told DN.se</a>.</p>
<p>Several of the lawyers, defendants and complainants apparently have fully-booked agendas, and it is difficult to schedule a date when everyone can participate. At the moment, it is still unclear how many days trial it will take once it starts. &#8220;We&#8217;re approximating between six to ten days,&#8221; Anita Thimberg said.</p>
<p>January 31st, four individuals - Fredrik Neij, Gottfrid Svartholm, Peter Sunde and businessman Carl Lundström were charged with facilitating copyright infringement. The prosecutor asked for a $188,000 fine for each - and the confiscation of their computers. The four also face up to 2 years in prison, but this is very unlikely based on the evidence gathered by the authorities.</p>
<p>That&#8217;s not all though, as the entertainment industry has also filed for damages. This spring, the <a href="http://torrentfreak.com/mpaa-demands-15-million-from-the-pirate-bay-080508/">MPAA demanded</a> $15.4 million from The Pirate Bay, to cover the damages they suffered from 4 movies and 13 TV-episodes that were made available via the BitTorrent tracker. In addition, the <a href="http://torrentfreak.com/ifpi-demands-millions-080331/">IFPI claimed</a> $2.5 milion in damages and Antipiratbyrån asked for $1.1 million.</p>
<p>Pirate Bay co-founder Peter Sunde has always been positive about the outcome. Even in the worst case scenario the tracker and the site will remain online, Sunde <a href="http://torrentfreak.com/pirate-bay-is-safe-080131">told TorrentFreak</a>. “In case we lose the pending trial (yeah right) there will still not be any changes to the site. The Pirate Bay will keep operating just as always. We’ve been here for years and we will be here many more.” </p>

<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay" />Yesterday, The Pirate Bay filed an appeal against the <a href="http://www.ictlex.net/?p=934">decree</a> that forced Italian ISPs to <a href="http://torrentfreak.com/the-pirate-bay-blocked-in-italy-080809/">block the BitTorrent tracker</a>. Pirate Bay&#8217;s lawyers Giovanni Battista Gallus and Francesco Micozzi are convinced that they have a strong case. &#8220;The decree can be defined as &#8216;original&#8217; or &#8216;creative&#8217; at best&#8221; they told TorrentFreak. </p>
<p>The Pirate Bay administrators are accused of making copyrighted material available on the Internet for commercial purposes. Giovanni and Francesco told us that this is a strange accusation, considering the nature of the site. &#8220;&#8230;even the judge who issued the decree states that no infringing material is hosted on The Pirate Bay, which provides just a tracker search engine,&#8221; they told us.</p>
<p>&#8220;The judge tries to &#8216;create&#8217; a sort of contributory infringement accusation against The Pirate Bay,&#8221; the lawyers explained. It is alleged that the tracker and the search engine are absolutely necessary for the users to &#8220;search and locate the content on single computers&#8221;. That&#8217;s not all, the judge goes even further by stating that the name of the site, &#8216;The Pirate Bay&#8217;, signals intent to infringe copyright. </p>
<p>The lawyers think that because of the lack of jurisdiction, the block should not have been issued in the first place. They also dispute the claim that The Pirate Bay is distributing copyright infringing material. &#8220;We will bring all our arguments before the Tribunal, and we are confident of the Tribunal&#8217;s decision,&#8221; they said.</p>
<p>In previous articles, we suggested that the IFPI, Pirate Bay&#8217;s arch rival, might have had a hand in the block. The reverse DNS of the &#8216;blocked page&#8217; <a href="http://torrentfreak.com/ifpi-hijacks-pirate-bay-traffic-080815/">pointed to IFPI&#8217;s servers</a>, although they have <a href="http://blog.brokep.com/2008/08/19/obstruction-of-justice/">changed that</a> now. This is suspicious to say the least, and Pirate Bay&#8217;s lawyers told us: &#8220;It is clear that this decree has been strongly backed up by FIMI (the Italian IFPI),&#8221; citing a press release FIMI published where they applauded the Pirate Bay block. </p>
<p>A Tribunal of three judges will now look into the appeal, and a decision is expected in a few weeks. After that, the decision of the Tribunal can be further appealed by both parties before the Higher Court. </p>

<p><img src="http://torrentfreak.com/images/beijing-olympic-2008.jpg" align="right" alt="top gear" />Last week we reported that the Opening Ceremony had been downloaded by more than <a href="http://torrentfreak.com/millions-download-olympics-via-bittorrent-080812/">a million people</a>, and this figure has doubled over the past 7 days. However, there is less demand for the other Olympic events, as most of these get less than 20,000 downloads.</p>
<p>Compared to 2004, the availability of Olympic events on BitTorrent has <a href="http://waxy.org/2008/08/pirating_the_olympics_then_and_now/">grown significantly</a>, both in quantity and quality. Interestingly, the demand for Olympic torrents is the greatest <a href="http://wiredset.com/blogs/markghuneim/2008/08/torrent-downloads-by-country-b.html">in China</a>, as 65% of the people who downloaded the Openings Ceremony come from the host country. </p>
<p>The International Olympic Committee (IOC) is not pleased seeing their shows on BitTorrent sites though. Yesterday they even <a href="http://torrentfreak.com/ioc-wants-olympic-torrents-off-the-pirate-bay/">sent a letter</a> (<a href="http://blog.brokep.com/2008/08/19/fioc-you/">read it here</a>) to the Swedish Minister of Justice, urging her to take on The Pirate Bay. From the letter, it looks like they have been reading last week&#8217;s article. &#8220;Our technical advisor Informs us that as many as 1 million copies of the Opening Ceremony have been illegally downloaded worldwide, with the most significant activity taking place through Pirate Bay,&#8221; they write.</p>
<p>The IOC claims to have contacted The Pirate Bay with a takedown request, but turned to the Minister when they got no response. The Pirate Bay denies this, and Pirate Bay co-founder Peter Sunde <a href="http://blog.brokep.com/2008/08/19/fioc-you/">writes</a>: &#8220;The phone hasn’t rung. And I guess their e-mail probably got caught in the Chinese firewall, since TPB is blocked there.&#8221;</p>
<p>From the letter, it seems that the IOC is predicting that the Closing Ceremony will hit BitTorrent immediately after the fireworks. &#8220;We are also gravely concerned about the upcoming Closing Ceremony on August 24, as it is entirely predictable that illegal copies of that event will be immediately made available through the Pirate Bay.&#8221; They are right of course, and we&#8217;re afraid that the Swedish government can&#8217;t do much about it either.</p>
<p>Today, the Minister said <a href="http://www.sr.se/cgi-bin/p3/nyhetssidor/artikel.asp?ProgramID=1646&amp;Artikel=2260362">in a radio interview</a> that The Pirate Bay is not really good promotion for Sweden (although some would <a href="http://blog.brokep.com/2007/11/30/ambassadors-for-sweden/">disagree</a>), but that there is indeed little they can do to stop the tracker from hosting torrent files. </p>
<p>It is not clear why the IOC is going after the Pirate Bay, and not any of the other BitTorrent sites. Of course, they are the most outspoken, but the majority of all the Olympic torrents are downloaded from other sites. Most BitTorrent sites do take down torrents when they are asked to, so it might be a good idea to start there&#8230;.</p>

            <description><![CDATA[<p>In an official letter to Swedish Minister of Justice Beatrice Alm, the International Olympic Committee (IOC) has asked for &#8220;assistance&#8221; from the Swedish government with preventing video clips from the Olympics in Beijing to be shared on The Pirate Bay. The Pirate Bay, however, does not plan to take anything down, and renamed their tracker to The Beijing Bay.</p>
<p><img src="http://torrentfreak.com/images/beijingbay.jpg" align="right" alt="pirate bay olympics" />The IOC is getting used to censoring the Internet, and has asked the Swedish government to help remove Olympic torrents from The Pirate Bay - which they claimed have been downloaded more than 1 million times. IOC also wants the government to assist in preventing (!) clips from the Olympics closing ceremonies to be shared.</p>
<p>Apparently the IOC has been reading <a href="http://torrentfreak.com/millions-download-olympics-via-bittorrent-080812/">the article</a> we wrote last week, which showed that millions of people are downloading the Olympic opening ceremony on BitTorrent. In the meantime, several other Olympic clips have been posted. Although these are not as popular as the opening ceremony, the gymnastics finals and other events get close to 50.000 downloads. </p>
<p>The press secretary of the Minister of Justice <a href="http://www.dn.se/DNet/jsp/polopoly.jsp?d=1042&amp;a=817598">has stated</a> that it is primarily clips from the Opening ceremonies that the IOC wants to stop. The Committee also questions the legal situation and wants to be informed on whether they can take measures themselves to prohibit videos of the Olympics to be shared.</p>
<p>It&#8217;s interesting that the IOC chose to contact the Swedish government, instead of The Pirate Bay. They probably realize that sending a takedown notice wouldn&#8217;t be that effective. Pirate Bay co-founder Peter Sunde told TorrentFreak: &#8220;I think it&#8217;s good that IOC understands that they will get nowhere with sending a legal threat to us. It shows they&#8217;re smart and without manners.&#8221;</p>
<p>&#8220;We were going to ignore the Olympics, but now we&#8217;re loading our cannons. Our weapons of mass distribution is pointed towards China.&#8221; The first action The Pirate Bay took is creating a new logo for the site, and renaming it to <a href="http://thepiratebay.org/">The Beijing Bay</a>. In true Pirate Bay style the <a href="http://thepiratebay.org">front page logo</a> now links to the tag &#8220;give us the gold,&#8221; Peter said.</p>
<p>The tag refers to the <a href="http://www.telegraph.co.uk/sport/othersports/olympics/2557320/Swedish-wrestler-Ara-Abrahamian-throws-away-medal-in-Olympic-hissy-fit.html">incident with the Swedish wrestler</a> last week, who tossed away his bronze medal after he lost his chance on a Gold medal because of an error made by the jury. Peter told us: &#8220;I also hope that the Swedish government will report back to them and tell them to give us the gold that the IOC stole from the Swedish wrestler. And to tell them to not host the Olympics in a country without any human rights.&#8221;</p>
<p>Of course, the solution to IOC&#8217;s BitTorrent problem is easy. By not televising the closing ceremonies, the IOC not only hinders filesharers, but also makes sure VHS tapers worldwide won&#8217;t be able to steal the Olympic spirit. Sounds like a winner.</p>

            <title>IFPI Hijacks Pirate Bay Traffic</title>

            <description><![CDATA[<p>Last Friday, Italian ISPs started to prevent their customers from accessing the Pirate Bay. Strangely enough, Pirate Bay traffic is not redirected to Italian authorities, but to the IFPI, the infamous anti-piracy lobby of the music industry. Pirate Bay&#8217;s Peter Sunde is not happy, and says it&#8217;s a scandal.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="the pirate bay" />For now, potential Italian Pirate Bay users are <a href="http://torrentfreak.com/the-pirate-bay-blocked-in-italy-080809/">denied access</a> to the BitTorrent tracker, and Italian authorities are investigating whether the site should be blocked indefinitely. The block totally missed its purpose though, as The Pirate Bay saw an <a href="http://torrentfreak.com/the-pirate-bay-sees-boost-in-italian-traffic-following-block-080815/">increase in traffic from Italy</a> instead of a decline.</p>
<p>The Pirate Bay has already taken several countermeasures to make sure Italians can access the site. These don&#8217;t work across all ISPs yet, and those users are redirected to the <a href="http://217.144.82.26/pb/">following page</a> by their ISP. Interestingly, this page is hosted on a server that belongs to IFPI - a <a href="http://whois.domaintools.com/217.144.82.26">reverse IP lookup</a> shows that the page is linked to www.pro-music.org, IFPI&#8217;s legal music site.</p>
<p>&#8220;I think it&#8217;s a scandal,&#8221; Pirate Bay co-founder Peter Sunde told TorrentFreak in response to this remarkable finding. &#8220;I hope that people start noticing that IFPI gets more and more into bed with the police. It&#8217;s really disturbing that one side of an ongoing fight gets more authority without a legal basis.&#8221;</p>
<p>Peter finds it hard to believe that the IFPI now gets all the traffic destined for the Pirate Bay, without any legal grounds, and he urges Italian users to clear their cookies before the IFPI decides to steal them. We have to agree with Peter here, it is indeed very disturbing that the traffic is redirected to a site which belongs to an anti-piracy lobby, instead of diverting neutrally to the ISP or local authorities.</p>
<p>The IFPI was contacted for a response several days ago, but hasn&#8217;t replied so far. It&#8217;s not the first time that they&#8217;ve &#8220;hijacked&#8221; traffic from a torrent site. Last October they did the same thing with <a href="http://torrentfreak.com/why_are_the_ifpi_and_bpi_allowed_071024/">the OiNK domain</a>. That instance was even worse, as they used the opportunity to <a href="http://torrentfreak.com/oink-investigation-seeks-identities-and-activities-of-users-071023/">threaten</a> members of the BitTorrent tracker, in advance of any trial.</p>
<p>Last October, the IFPI lost their .com domain, which was mysteriously transferred <a href="http://torrentfreak.com/ifpi-now-owned-by-the-piratebay-071012/">to the Pirate Bay</a>, who started International Federation of Pirate Interests. Even though the IFPI managed to get the domain back in their possession, the incident marked an increase in efforts from the organization to take out The Pirate Bay. </p>
<p>Thus far, only John Kennedy, chairman and chief executive of the IFPI, has responded to the Italian move against The Pirate Bay stating: &#8220;This decision sends out a clear message that The Pirate Bay&#8217;s activities are illegal under Italian law. The Pirate Bay facilitates the mass infringement of copyright across music, film, television and games. Its very name shows the contempt its operators hold for the creators of legitimate content.&#8221;</p>
<p>Italy is trying hard to get rid of <a href="http://news.bbc.co.uk/2/hi/europe/7561762.stm">their fascist label</a>, and some Italians were quite upset about the Pirate Bay calling their country a <a href="http://thepiratebay.org/blog/123">fascist state</a>, but scandals like this don&#8217;t help to improve this image. Things get even worse if you take into account that the IFPI <a href="http://torrentfreak.com/ifpi-erases-evidence-of-fascist-roots-for-75th-anniversary-080408/">covered up</a> the fact that the organization was founded in Rome, Italy, under the watch of Mussolini, one of the greatest fascist dictators. Enough said.</p>

            <description><![CDATA[<p>Following the decision in Italy to block access to The Pirate Bay comes the inevitable announcement. Has the world&#8217;s largest BitTorrent tracker faded away in the face of media industry pressure? Hardly. Traffic from Italy to the &#8216;bay has actually increased this week and the site has jumped 10 places on Alexa in Italy.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay" /> It&#8217;s been all over the news this week. Following attempts in other countries to <a href="http://torrentfreak.com/pirate-bay-blocked-by-isp-080204/">block access</a> to The Pirate Bay, this week saw the Italians <a href="http://torrentfreak.com/the-pirate-bay-blocked-in-italy-080809/">take their turn</a>. Could they succeed where they had previously failed and actually force a decrease in traffic to a site they block?</p>
<p>Some ISPs have <a href="http://torrentfreak.com/swedish-isp-refuses-to-block-pirate-bay-080327/">refused to block</a> the site in the past but in any event, most attempts only seem to provide free advertising for the site and subsequent increases in traffic.</p>
<p>Unfortunately for the people at the IFPI - the driving force behind the block - the results so far aren&#8217;t what they&#8217;d hoped for. Rather like the increases in traffic experienced at <a href="http://torrentfreak.com/ifpi-advertising-boosts-traffic-080312">HTTPShare</a> when they tried to block that, this week has seen traffic from Italy to The Pirate Bay increase too.</p>
<p>Brokep from The Pirate Bay has announced that while the tracker has never been &#8220;particularly big in Italy&#8221;, the recent attempted block actually seems to have done them a favor.</p>
<p>&#8220;Since the block we’ve increased traffic from Italy,&#8221; <a href="http://blog.brokep.com/2008/08/15/fascists-0-internets-1/">he says</a>. &#8220;We gained 10 places on Alexa in Italy, and our own stats show a 5% increase in traffic from Italy (which has been quite stable before),&#8221; which is understandable considering the masses of worldwide <a href="http://news.google.com/news?hl=en&amp;tab=wn&amp;ned=us&amp;q=the+pirate+bay&amp;btnG=Search+News">press coverage</a> this week, a fact not lost on brokep:</p>
<p>&#8220;It’s quite interesting and my guess (with background about what happened in <a href="http://torrentfreak.com/pirate-bay-blocked-by-isp-080204/">Denmark</a>) is that the site will gain even more attention over the coming weeks in the media and also get a lot of new visitors.&#8221;</p>
<p>It seems unthinkable that there could be any other result. The music and movies industries might hate The Pirate Bay with a passion but millions upon millions of regular people love them. It&#8217;s difficult to keep that level enthusiasm down.</p>

            <title>MediaDefender Walks The Plank to Bankruptcy</title>

            <description><![CDATA[<p>MediaDefender and parent company ArtistDirect have had some serious setbacks recently. Last September they suffered a huge security breach when internal emails and a phone call were leaked to BitTorrent. They received even more bad press recently for DDoSsing Revision3. As a result, MediaDefender&#8217;s parent company stock dropped from $2.00 down to just 16 cents.</p>
<p><img src="http://torrentfreak.com/images/mediadefender-plank.jpg" align="right" alt="mediadefender stock" />Mediadefender has had a rough year, and the future isn&#8217;t looking much better. Last month, MediaDefender lost one of its larger customers. The business accounted for roughly 18% of MediaDefender&#8217;s revenues. </p>
<p>In a recent financial statement, the company stated that there is a decrease in interest for their anti-piracy services, and that the results of their <a href="http://torrentfreak.com/mediadefender-goes-forward-with-p2p-marketing-080614/">p2p-advertising</a> model are also disappointing. This news led to further decrease in the stock price, which was sitting at an all time low of just 16 cents this Monday.</p>
<p>Surprisingly enough, the company structurally fails to mention the <a href="http://torrentfreak.com/mediadefender-emails-leaked-070915/">email leak and security breach</a>, which has cost them a significant amount of money. In September 2007, disaster struck. MediaDefender had made many enemies with its anti-p2p activities. One of them decided to teach the company a lesson by hacking into their systems and leaking their internal emails and closest secrets to the Internet. The effect on the company and its operations was dramatic.</p>
<p>In an <a href="http://www.portfolio.com/news-markets/national-news/portfolio/2008/01/14/Media-Defenders-Profile#page1">interview with Portfolio</a>, the hacker (using the pseudonym ‘Ethan’) explained how things led up to the leak. Ethan, a polite high-school student who lives with his family, was on his Christmas break when he first gained access to the anti-piracy company&#8217;s servers by exploiting a weakness in their firewall. This was at the end of 2006, at a time when business was still good for Media Defender with revenue standing at nearly $16m.</p>
<p>Soon after that Ethan got access to the company’s email, its networked resources and even its telephone system. Logging in a handful of times each month through the summer of 2007, he started to get bored with ‘Monkey Defenders’ - his pet name for the anti-piracy outfit. Deciding to go out with a bang, he and the Media Defender-Defenders gathered thousands of the company’s internal emails and published them on web.</p>
<p>Last November, MediaDefender said it lost $825,000 as a result of the leaked emails, and this amount has probably gone up significantly in the months after that. Its stock price is falling, and it&#8217;s beginning to look like the company won&#8217;t recover anytime soon. The Pirate Bay <a href="http://torrentfreak.com/the-piratebay-wants-mediadefender-to-walk-the-bankruptcy-plank/">wished</a> last year that MediaDefender would go bankrupt, and by the looks of it, they might just get what they hoped for&#8230;</p>

            <title>The Pirate Bay Now Supports Tagging</title>

            <description><![CDATA[<p>The Pirate Bay has rolled out a new feature which allows users to add tags to the torrents they upload. The tags will make it easier to structure and discover new content, and it gives users the opportunity to form tag based groups.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay" />Although tags are fairly common for blogs and other online publications, The Pirate Bay is one of the first BitTorrent sites to implement this feature. The purpose is to make it easier for users to discover content they are interested in, and structure and organize torrents more easily.</p>
<p>The <a href="http://thepiratebay.org/tags">tag cloud</a> still has to be filled, but when it does, Pirate Bay users will have the option to browse through tag based archives. In the days to come, support for tag based RSS feeds will be added, and the option to browse tags per category.</p>
<p>Among other things, the tags will allow users to form micro communities within the site, as Pirate Bay co-founder Peter Sunde explained: &#8220;Let&#8217;s say I run a small movie club or whatever, just tag the uploads with my club name and it will be on the same page. The new feature adds genres to all the stuff as well, and i&#8217;m making a tag browser per category.&#8221; Peter further told TorrentFreak that they will be introducing some more additions to the site this weekend. </p>
<p>The new tag feature marks the end of a turbulent week, with <a href="http://torrentfreak.com/pirate-bay-facing-server-troubles-and-downtime-080729/">many hours of downtime</a>, which should be over by now. In a few weeks, The Bay plans to move some servers, but until then, the site should remain up and running. Stay tuned for updates.</p>

Although Warner did all it can to protect the film from leaking, a Cam version leaked onto BitTorrent sites soon after it premiered.</p>
<p><img src="http://torrentfreak.com/images/piratebat.jpg" alt="pirate bay dark knight" align="right" />The Dark Knight has been a huge success in theaters. In its first weekend, the film grossed a <a href="http://news.yahoo.com/s/ap/20080721/ap_en_mo/box_office">record breaking $158.4 million</a>, and it&#8217;s currently on top of IMDB&#8217;s <a href="http://www.imdb.com/chart/top">top 250</a> movies of all time with an average rating of 9.3.</p>
<p>The Pirate Bay now joins the hype, as the renamed their site into &#8220;<a href="http://thepiratebay.org/">The Pirate Bat</a>&#8220;, and put up a new logo that links to a search for &#8220;The Dark Knight&#8221;.</p>
<p>A week ago the police <a href="http://torrentfreak.com/police-arrest-man-camming-dark-knight-movie-080720/">arrested a man</a> who tried to record the movie with a camcorder. However, they couldn&#8217;t stop all cammers, and it didn&#8217;t take long before a leak got onto various BitTorrent sites. <a href="http://www.rlslog.net/the-dark-knight-cam-xvid-tradingstandards/">Rlslog reported</a> last week that a copy of &#8220;The Dark Knight&#8221;, was published by a release group called “TradingStandards”. As usual, reports say that the quality of the leak is pretty poor. There has since been a <a href="http://en.wikipedia.org/wiki/Telesync">Telesync</a> of the movie <a href="http://www.vcdreview.com/info.php/i-78134.html">released</a>, which means if nothing else, the sound will be better.</p>
<p>This is not the first time that The Pirate Bay has rebranded its site to piss off content owners. When Apple&#8217;s OSX x86 leaked. in July 2005, they renamed the site to the <a href="http://static.thepiratebay.org/doodles/pearbay.png">Pear Bay</a>, and linked to the leaked torrent. Back in July 2005 The Pirate Bay put up a logo inspired on Grand Theft Auto for the release of their new website, the <a href="http://static.thepiratebay.org/doodles/gtb.jpg">Grand Theft Bay</a>. Apart from being creative with their logo&#8217;s TPB is known for their <a href="http://torrentfreak.com/dont-humiliate-yourself-complaining-to-the-pirate-bay-080625/">hilarious responses</a> to copyright owners who request takedowns.</p>

            <description><![CDATA[<p>Court documents show that a hacker, hired by the MPAA, offered to reveal the identities of the Pirate Bay founders. The hacker, who also retrieved private information from TorrentSpy, was paid $15.000 for his efforts.</p>
<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay hacker" />It turns out that the MPAA will do pretty much anything to obtain information about BitTorrent sites and its users. Back in 2006, they <a href="http://news.com.com/2100-1030_3-6076665.html?part=rss&amp;tag=6076665&amp;subj=news">made a deal</a> with a &#8220;hacker&#8221;, better known as Robert Anderson, to steal e-mail correspondence and trade secrets from TorrentSpy. </p>
<p>The hacker later admitted that this was indeed true, and in a surprising turn of events, he switched sides, and <a href="http://torrentfreak.com/mpaa-hacker-now-working-with-torrentspy/">joined TorrentSpy</a>. The court case between the MPAA and TorrentSpy eventually led to the <a href="http://torrentfreak.com/torrentspy-slapped-110-million-080507/">downfall of TorrentSpy</a>, but it turned out that the MPAA was also interested in intel on The Pirate Bay.</p>
<p><a href="http://news.cnet.com/8301-1023_3-9999018-93.html">Cnet cites</a> court documents showing that Anderson wrote to the MPAA: &#8220;We can provide the names, address, and phone (numbers) of the owners of Torrentspy.com and Thepiratebay.org &#8212; along with evidence, including correspondence between the two companies.&#8221;</p>
<p>In addition, the court documents reveal that MPAA&#8217;s Dean Garfield stated: &#8220;We were going to get information about the location and identity of the people who were running Torrentspy, as well as information related to a general conspiracy and relationship between Torrentspy and a number of other prominent services including ThePirateBay.&#8221; </p>
<p>The Pirate Bay has always been one of the main targets of the MPAA. In 2006, John Malcolm, Executive Vice President of the MPAA <a href="http://torrentfreak.com//images/pirate_mpa.pdf">wrote a letter</a> to Sweden’s State Secretary in which he urged the authorities to take action against the site: “It is certainly not in Sweden’s best interests to earn a reputation among other nations and trading partners as a place where utter lawlessness with respect to intellectual property rights is tolerated.”</p>
<p>It is of course interesting to see that the MPAA is interested in the identities of the Pirate Bay founders, but they could have easily done a Google search, because that info is pretty much public information. I guess they rather use a hacker.</p>
<p>The Pirate Bay website is offline at the moment, unrelated to this news, as they are doing some server maintenance.</p>

            <description><![CDATA[<p>The Pirate Bay, often attacked by the Swedish establishment, but never beaten. However, their faith in the judicial system has plummeted after prosecutors have stated that Jim Keyzer, a police official investigating the Pirate Bay, has done no wrong by working for Warner at the same time.</p>

Jim Keyzer, a Police IT forensics specialist who was leading the Pirate Bay investigation, let it <a href="http://torrentfreak.com/chief-investigator-pirate-bay-employed-by-plaintiff-080418/">slip</a> he was working for Warner on a <a href="http://torrentfreak.com/pirate-bay-investigator-to-cash-in-at-warner-bros-080423/">social networking site</a>. A strange move to say the least.</p>
<p>Soon after the news got out it became clear that Keyzer had started working for the movie studio before the Pirate Bay investigation was closed. Warner denied this initially, and stated that the investigator was not employed or paid by the movie studio while he was still working on the case.</p>
<p>However, after The Pirate Bay crew <a href="http://torrentfreak.com/the-pirate-bay-file-police-bribery-complaint-080516/">filed</a> criminal complaints for bribery of a police officer, Warner suddenly <a href="http://torrentfreak.com/warner-confesses-pirate-bay-cop-compromised-080605/">admitted</a> he was working for them.</p>
<p>Pirate Bay co-founder Peter Sunde was convinced that they had a strong case, as he said: “He [Keyzer] confirmed that he is an employee there [Warner Bros'] and we can’t see it in any other way than this being the reward for work well done from the new employer of the police, the entertainment industry”</p>
<p>However, in a letter received today by Peter Sunde, Kay Engfeldt of the prosecutors department states that there will be <a href="http://blog.brokep.com/2008/07/08/prosecutor-will-not-investigate-jim-keyzer/" target="_blank">no investigation into Jim Keyzer</a>. &#8220;[there is] no reason to believe that a crime has been committed by anyone employed by the police.&#8221;</p>
<p>Of course, until you investigate, you won&#8217;t find any evidence. That&#8217;s why in general allegations are investigated first, especially when there is evidence to back up the claim. Sunde told TorrentFreak that they would be filing an appeal on Monday.</p>
<p>In the meantime, they&#8217;re working on a datacenter move for their secondary sites, which had left  services like Bayimg unavailable for a time.</p>

            <description><![CDATA[<p>BitTorrent’s popularity is growing every day. Despite the lawsuits that  some of the larger torrent sites are involved in, they continue to grow traffic wise. Let&#8217;s take a look at how Google ranks the top torrent sites.</p>
<p>It is hard to make a definite list of the most popular BitTorrent sites. Over the years we&#8217;ve made quite a few lists, and reported some of the latest trends. Most lists we published were based on <a href="http://alexa.com">Alexa</a>&#8217;s ranking, mainly because it was pretty much the only traffic source that was available. Recently, however, Google started to rank websites as well, including a traffic estimate.</p>
<p>So, let&#8217;s see <a href="http://trends.google.com/websites?q=mininova.org%2C+thepiratebay.org%2C+isohunt.com%2C+torrentz.com&amp;geo=all&amp;date=all&amp;sort=0">how well Google does</a>, and how their traffic estimation and ranking compares to actual traffic data and Alexa&#8217;s ranking respectively.</p>

<p>One of the interesting features of Google&#8217;s site comparison is that it gives an estimation of the daily traffic when you&#8217;re logged in on a Google account. The data used for the traffic statistics comes from Google analytics, consumer panels, and other third-party market research.</p>
<p>The traffic data seem to be quite accurate, for some sites at least. The daily (absolute) unique visitors for Mininova, for example, is estimated to be slightly above 2 million a day, which matches with real traffic stats we got from the Mininova team. </p>
<p>As we look at the graph below we can clearly see that <a href="http://mininova.org">Mininova</a> is in the lead judging by the number of visitors, followed by <a href="http://thepiratebay.org">The Pirate Bay</a>. <a href="http://isohunt.com">isoHunt</a> and <a href="http://torrentz.com">Torrentz</a> compete for the third place. After these four sites there is a huge gap to other BitTorrent sites such as <a href="http://btjunkie.org">BTjunkie</a>, <a href="http://www.torrentreactor.net/">TorrentReactor</a> and <a href="http://torrentportal.com">TorrentPortal</a>.</p>
<p>It is interesting to see how many similarities there are between Google&#8217;s ranking, and the daily reach according to Alexa.</p>

<p>The regional differences in popularity of the sites are also worth mentioning. The Pirate Bay, for example, is more popular than Mininova in the US, and especially in <a href="http://trends.google.com/websites?q=mininova.org%2C+thepiratebay.org%2C+isohunt.com%2C+torrentz.com&amp;geo=SE&amp;date=all&amp;sort=0">Sweden</a>. Torrentz, on the other hand, does really well in India, while isoHunt has a relatively large fanbase in Japan.</p>
<p>Overall it seems that BitTorrent sites are still growing, especially The Pirate Bay, since they nearly doubled their traffic in a yeah. This is pretty much in line with the growth in the number of peers on The Pirate Bay trackers, which went from 5 to well over 10 million in the last 12 months.</p>

Indiana wanted The Pirate Bay to remove torrents linking to her work, which they refused to do. Now Indiana has a response for The Pirate Bay and file-sharers in general. It doesn&#8217;t pull many punches.</p>
<p><img src="http://torrentfreak.com/images/indiana.jpg" align="right" alt="IndianaGregg" />Recently we <a href="http://torrentfreak.com/dont-humiliate-yourself-complaining-to-the-pirate-bay-080625/">wrote</a> about the exchange of emails between vocalist Indiana Gregg and Peter Sunde at The Pirate Bay. Indiana and her label asked Peter to remove some torrents but he refused, instead publishing the details of their correspondence in the site&#8217;s &#8216;legal&#8217; section. The exchange caused quite a stir on the web and the news today is that the debate is not over - at least as far as Indiana is concerned, turns out she has a lot to say - as well as sing.</p>
<p>TorrentFreak heard that Indiana had a message for The Pirate Bay, the BitTorrent community and file-sharers in general, so we caught up with her to find out exactly what. She told us that although she agrees with the concept of file sharing, she believes that musicians and writers need to make a living or at least enough money to enable them to re-invest into their creation. She also gave us her opinions about how file-sharing will be &#8216;policed&#8217; in the future and notes that the methods may not be 100% fair. &#8220;With all forms of change, there are always the up-sides and down-sides,&#8221; she told us.</p>
<p>It&#8217;s not very often an artist will speak as openly or at such length on this subject as Indiana has. Some people are going to like what she has to say. Thousands, maybe millions are going to hate it, but there isn&#8217;t a debate when only one side speaks  - so here it is - uncensored, controversial, outrageous and thought provoking.</p>
<p>Something tells us this debate is far from over&#8230;..</p>
<p>I felt misrepresented in the first article and obviously, my attempt at humor by stating I&#8217;m a &#8216;millionaire&#8217; wasn&#8217;t appropriately quantified.  Am I a millionaire because I have millions of ants in my garden? Is it because I have had millions of people listen to my music on sites like MySpace or YouTube? Is it because I&#8217;m grateful to be healthy?  How people quantify &#8216;richness&#8217; in their lives depends on how people perceive value.  And, yes, I&#8217;m guilty of fueling Peter Sunde&#8217;s fire and animosity. I can image it&#8217;s not easy in his position just now considering the amount of angry artistic people who are fronting against his cause.  I&#8217;m sure he has his core values that he wants to defend&#8230; I have mine&#8230; and I&#8217;m not afraid to speak about them&#8230; for the sake of music.. and the common good.</p>
<p>The Pirate Bay: The Sinking Ship&#8230;..My Response</p>
<p>The Wild West of the Internet seems to be getting seriously out of hand and i&#8217;ve been wondering if and when the Internet Police will come and sort it all out. I mean… this is the new Wild West…</p>
<p>We&#8217;ve all heard and read every form of complaint about the Internet. From cyber-bullying, to child pornography sites, to copyright theft in the form of &#8216;file-sharing&#8217;.</p>
<p>Imagine….What if the Internet had &#8216;frontiers&#8217;. Why can we go all over the world on the Internet without a passport? Why are cybernauts allowed to steal goods from the store &#8217;shelves&#8217; and &#8217;shop windows&#8217; and justify it as &#8217;sharing&#8217;? Since the birth of the Internet, people have been hacking software, stealing music, books, films, television shows, credit card numbers, eBay accounts, IP addresses&#8230; you name it, if it&#8217;s out there and can be downloaded, it&#8217;s being virtually stolen from under your nose.</p>
<p>So, why is this Wild West so hard to monitor? Why are people up in arms and waiving their guns wildly… … Are these new pirate ships sharing other people&#8217;s goods for gold? Of course they are… yes, I&#8217;m speaking about the torrent sites… and all the other sites who are making money on other people&#8217;s back…</p>
<p>Is the Internet really that much &#8216;bigger&#8217; than the &#8216;real&#8217; world? I think not. I believe that in the near future, we will all be using our Internet passports. If the government can do it in the real world, what&#8217;s stopping them from monitoring this new &#8216;Wild West&#8217; phenomenon of the Internet in every town, city, state and country. I mean… Don&#8217;t we have just as much right as citizens to be protected on the Internet as we would be anywhere else? And really, the only people who would disagree with this idea are people who either are engaging in illegal activity or people who claim &#8216;civil liberty and freedom of speech&#8217; on the Internet, but remember guys, those freedoms are only good until you begin to harm other people.</p>
<p>You don&#8217;t have freedom to shout from the rooftops at 3am outside your neighbor&#8217;s house&#8230;. and it&#8217;s certainly not your civil right to steal from your local baker and share his cream puffs outside his shop window…either, is it? Allow me to explain.</p>
<p>Let&#8217;s take one of the major forces on the Internet for example. Let&#8217;s look at all of the big music content sites (such as MySpace, Yahoo Music, etc) who seem to be huge driving swarms of traffic on the Internet. When you see the amount of advertisements per page and click, you know you can almost hear the &#8216;kerching&#8217;. These sites are like interstate junctions at rush hour (24 hours a day) so to speak. Torrents are no different…. Kerching kerching… They are giving away things like films, music, tv programs, software…. If it can be downloaded, it can be found… for free…</p>
<p>Thousands upon thousands of websites, sharing sites, and torrent sites exist. These websites are making a constant steady flow of income by using other people&#8217;s goods&#8230;they are pointing people to the goods (music) for free and selling masses of advertisement because people come to &#8216;leech&#8217; the goods&#8230;these sites are basically allowing people to steal and destroy the music industry (which is in fact like shooting themselves in their own foot). The sites themselves claim to be &#8216;legal&#8217;. It is the user&#8217;s responsibility not to share copyrighted files.</p>
<p>So, you&#8217;d be silly to think that the Internet police are not planning on coming. How easy would it be to simply find all these people who are illegally &#8217;sharing&#8217; and slap a lawsuit on them. They can do that with a virtual push of a button. How hard do you think it will be for the ISP&#8217;s to hand over your Internet passport over to the new frontier police? They can see how much you&#8217;ve &#8217;shared&#8217; and potentially fine every single torrent user. I bet the torrent sites wouldn&#8217;t like that very much. Suddenly all their users would disappear.</p>
<p>Last year, in an article on Sky News, I read that a woman received a massive fine for file sharing on the KaZaA network. I thought, great! The police are coming.Then my husband sent me a link to another article titled &#8220;Should You Pay For Music?&#8221; I instantly thought&#8230;.eh? Has the world gone mad? It&#8217;s like saying &#8220;Should you pay for petrol?&#8221; or &#8220;Should you pay for bread?&#8221; Hey, maybe I was being too &#8216;traditional&#8217;? I guess you could compare it to you, yourself, working all week long. You go to the bank and cash your check, and the banker takes your money without putting it into your account.</p>
<p>But, it&#8217;s much deeper than this. Whether or not the public is offered music for free or at a cost is not the real issue. The real problem lies in the fact that &#8217;share&#8217; sites are making money by pointing to other people&#8217;s copyrighted content&#8230; The end user gets it for free… the torrents make money…. And the musicians and artists?? Well, they get to live off of &#8216;fresh air&#8217;. Put simply, musicians will not be able to exist financially in order to create music if income streams are cut off (whether or not a record label comes to play).</p>
<p>And this is exactly what is happening.</p>
<p>As a musician and an independent record-label, I see my livelihood being sucked away every day through file-sharing and torrent sites which are allowing copyright material to flow in and out of their sites. All they have to do is claim that it&#8217;s the responsibility of the user to make sure the content they are sharing is not copyright protected material. Last year, in a period of two weeks, we tracked and found over 100,000 leechers of my album alone. Since then, we&#8217;ve found about 150,000 more, of which I, the artist, who put my heart and soul, time and sweat into an album and raising money to market that album, haven&#8217;t received a dime, not one red cent. Full torrent files of a complete album! Since it&#8217;s so easy to &#8217;share&#8217; the music&#8230;.</p>
<p>In the real world, if everyone walked into HMV and took as many albums as they like&#8230; and said they were &#8217;sharing&#8217;&#8230;errr&#8230; shoplifting? I really don&#8217;t see how people think they can give music or any other form of media for &#8216;free&#8217; without it hurting the livelihoods of musicians. Sharing of copyright protected material is 100% illegal. However, since it&#8217;s not being regulated, it&#8217;s as if all of us musicians have just left the shop door open so that anybody can lift our guitars and gear out on the street and drive off with it. Isn&#8217;t that what&#8217;s happening? If you can&#8217;t make a dime from that album you just spent all your money, time and effort on because everyone is &#8217;sharing&#8217; it, then how are you going to buy your guitar strings, pay your landlord, or eat? You&#8217;ll be selling your gear soon and asking the boss for overtime. Right?</p>
<p>Torrent sites are claiming that they are creating &#8216;free promotion&#8217; for musicians&#8230;. that&#8217;s right.. they claim that by giving all these people the opportunity to &#8220;share&#8221; the music, they are doing all of us musicians a big huge favor. In fact, they think that musician&#8217;s, songwriters, sound engineers, mastering companies, etc&#8230; should all live on &#8216;pure fresh air&#8217;. They blatantly state that they think it should be enough for a musician to make music out of their &#8216;passion&#8217; for music… and well, since it&#8217;s &#8216;art&#8217; it shouldn&#8217;t have a price&#8230;.. er, ok….. maybe we should go and see if Fender will start giving away free guitars? Free gear for everybody!!! Yipppeee&#8230;. Free strings, free amplifiers, free microphones and drum kits&#8230;&#8230;awww… how novel.</p>
<p>Here&#8217;s another funny one…the torrent site&#8217;s answer to how musicians are supposed to earn a living is: .. well, musician&#8217;s will just need to go out and gig some more in order to make a living. Maybe the band can sell a few more T-shirts, etc. etc. They rationalize stealing by stating that they go to gigs and buy tickets…(or that they plan to do so if ever their favorite band can finally afford to come and do a tour in their country). They claim that by allowing sharing, they are &#8216;leveling the playing field&#8217;.</p>
<p>Well, torrent sites are absolutely NOT leveling the playing field. They are just moving the field and reaping the benefits due to a temporary loophole in the law. I&#8217;ll bet that when all their users get slapped a fine for &#8217;sharing&#8217; in their respective countries the torrent sites won&#8217;t be there to support them. I doubt that they are planning to send all their users a bunch of &#8216;gold&#8217; off of their pirate ship. So far, there have only been a few &#8216;examples&#8217; made with users being slapped heavy fines. I have a hunch that this will CHANGE.</p>
<p>Aww, now there&#8217;s a word &#8220;CHANGE&#8221;.</p>
<p>Well, let&#8217;s talk about CHANGE for a moment. The torrent people even go as far as to quote Charles Darwin in an effort to justify theft:</p>
<p>&#8220;In nature, it&#8217;s not the strongest nor the most intelligent who survives. It&#8217;s the most adaptable to change.&#8221; (a quote from a torrent fanatic referring to Darwins theory).</p>
<p>Hmmm………..well, I assume that the torrent sites are planning to be adaptable pretty soon then, considering the number of pending lawsuits from pretty strong and intelligent companies who have not only proven their adaptability to change, but have changed the world as we know it (companies like Microsoft, for example).</p>
<p>Please.. spare us this kind of rhetoric guys. With the likes of Microsoft, Prince, and the IFPI going after you, any outsider might begin to wonder when YOU plan to adapt to &#8216;change&#8217;. It&#8217;s becoming evident that your business model is a sinking ship. Pretty soon, your users will be slapped with fines and more big companies will be slapping on lawsuits. Why not just sink your ship yourselves..eh? That&#8217;s really what you&#8217;re doing.. Your resistance to &#8216;change&#8217; is in complete conflict with your very survival… Oh the irony. &#8220;Let&#8217;s have all our users quote Darwin&#8221;.</p>
<p>&#8220;Sharing is caring&#8221;, so they say. Torrent sites are promoting the idea that if people are taking the time to &#8217;share&#8217; other peoples copyright material it means they care. So, what&#8217;s stopping the torrent pirates from &#8217;sharing&#8217; the revenue from the advertising on their sites? Funny how it&#8217;s ok for musicians to live off of &#8216;fresh air&#8217; but these pirates are meanwhile filling their boat with loot on the backs of other people&#8217;s hard work. Let&#8217;s see how adaptable to &#8216;change&#8217; they decide to become… and put their Darwin theory where their mouth is….</p>
<p>Free promotion? Basically, torrents are promoting music that has &#8216;already been promoted&#8217;, so it&#8217;s not &#8216;free promotion&#8217;. There will be a small percentage of people who go through the millions of songs that are being seeded and perhaps discover something new because they searched for something they had already heard about. So, torrents are not only &#8216;moving&#8217; the playing field, they are, in reality, making the playing field so un-even that bands are going to be the new &#8220;Sysiphus&#8217;s&#8221; trying to roll a ball uphill for eternity - although the sites would like to fool us all into believing otherwise.</p>

            <title>Don’t Humiliate Yourself Complaining to The Pirate Bay</title>

            <description><![CDATA[<p>When organizations and companies don&#8217;t like it that their material - be it music, movies, games or software - are indexed by a torrent site, very often they will contact the site in question and demand that the relevant .torrent files are removed. A lot of sites will remove the files but a few refuse.</p>
<p>Most people know that The Pirate Bay doesn&#8217;t like to remove torrents at the copyright holders request, in fact they claim they have never removed any. Instead, when a copyright holder enters into dialogue with the staff, instead of removing the files in question the site posts the discussions up in the &#8216;Legal Threats&#8217; section. Most of the discussions are entertaining to a degree, with some even extending to personal insults. </p>
<p>However, during the last few days, another copyright complaint and subsequent discussion has been posted and although many might find it funny, personally I found it quite embarrassing raising the question: Should copyright holders just keep their complaints to themselves to maintain some dignity - at least where The Pirate Bay is concerned?</p>
<p>The <a href="http://static.thepiratebay.org/legal/indianagregg_resp.txt">complaint</a> comes from Ian Morrow at UK based label <a href="http://www.gr8pop.net">Gr8pop</a> Ltd, representing American vocalist Indiana <a href="http://en.wikipedia.org/wiki/Indiana_Gregg">Gregg</a>. Morrow requested the removal of a .torrent linking to the album &#8220;Woman At Work&#8221;, but the request was worded in an unfortunate way which appeared to betray a lack of legal understanding:</p>
<blockquote><p>We request that you have the file removed immediately as this is legal copyright and has not been authorised to be released as an illegal download.</p></blockquote>
<p>Of course, it didn&#8217;t take long before Peter Sunde, aka brokep, decided to start tearing it apart:</p>
<blockquote><p>Is it possible to authorise something to be an illegal download? That would be a legal download if it would be authorised now, wouldn&#8217;t it. Also, i&#8217;ve never heard of &#8220;legal copyright&#8221; (nor illegal copyright for that matter). I think you need to re-check your intentions of the e-mail and try again. We do not respond to messages that do not make 100% perfect sense. You&#8217;re confused.</p></blockquote>
<p>The response back to Peter starts the farce ball rolling, as it always seems do with these complaints. Ian Morrow starts by insisting that BitTorrent or any other form of sharing is illegal, &#8220;full stop&#8221;, but of course, that&#8217;s not true. Not really a good start, but Ian is just warming up, informing Peter that &#8220;..having sat on cross parliamentary committees, resolved to regenerating music and culture in my country, I&#8217;m afraid you may just have picked the wrong person to cross swords with on this occasion.&#8221; </p>
<p>Indeed, the email to Peter was copied to many other people including many people in the Scottish parliament, the <a href="http://www.mcps-prs-alliance.co.uk/Pages/default.aspx">MCPS</a>, the <a href="http://www.ppluk.com/">PPL</a>, the late Roy Orbision&#8217;s wife and many other people, including Indiana herself.</p>
<p>However, things take a turn for the strange. Ian goes on to state that due to people sharing the album his company is almost bankrupt (along with him personally) and Indiana herself - despite her current position of No.1 in the MySpace charts and the 4th most viewed artist on YouTube. The inevitable response from Peter is what we have to come to expect:</p>
<blockquote><p>You&#8217;re a hoot, that&#8217;s what you are :) I want to hug you in a non-sexual way and tell you that you make my heart burst of joy and cuddle up like a cute little cookie monster and ask for more milk&#8230;. and btw, to be in a business you have very little knowledge on what you&#8217;re doing. I would actually see you as a retard, but it&#8217;s hard when you&#8217;re so cuddly and manly! I wish I was just 20 years older and a girl&#8230; oh my..</p></blockquote>
<p>Sadly, instead of realizing where all this is heading, Indiana Gregg herself steps in with a response of her own (including a lesson on copyright law - United States law), which basically gives Peter more ammunition to respond in his own inimitable style. It is all very messy and very embarrassing - and it gets worse.</p>
<p>Undeterred and armed with a shaky understanding of the scope of the law he&#8217;s trying to enforce, Ian writes back to Peter with a fairly detailed explanation of a torrent site&#8217;s obligations under the DMCA, but makes the same mistake as so many others. The DMCA is a US law and The Pirate Bay is not in the United States, leaving himself wide open for further ridicule.</p>
<p>Ian goes on to explain that he&#8217;s actually a millionaire after all, contradicting his earlier bankruptcy comments which were clearly designed to tug on Peter&#8217;s heart strings. Unfortunately when it comes to copyright, Peter&#8217;s heart is made of stone.</p>
<p>Which brings us to the point I raised at the start of this post. What actually is the point of complaining to The Pirate Bay? They aren&#8217;t going to take down any torrents and they will publicize all of these copyright discussions with the aim of making the sender look badly informed. Despite the deliberate (and probably calculated) juvenile tone adopted by Peter Sunde, the senders of the complaints always seem to come off worse, due to their very apparent lack of understanding of the law. </p>
<p>So, are these complaints down to sheer desperation or are these labels really that badly informed about the law? Maybe when Ian&#8217;s friends in the Scottish parliament see the correspondence they will be suitably outraged and pledge seriously to do something. Trouble is, if the law in Sweden can&#8217;t do anything about The Pirate Bay crew right now, what can be done at all?</p>
<p>As the complaints pile up and the stakes increase, The Pirate Bay continues on, treating the anti-pirates with contempt and offering them continuing public humiliation. It seems now that the only thing that can stop the site is a defeat in court, but since servers are scattered right around the world, all the signs point to the likelihood that even that won&#8217;t bring a halt to the torrents - or the complaints.</p>
