            <title>Warez Scene Member Gets 3 Years Probation, $2000 Fine</title>

            <description><![CDATA[<p>A Florida man was sentenced to three years probation on Thursday for his part in running a &#8216;warez&#8217; server. The 55 year old, known online as &#8216;kidzap&#8217;, would&#8217;ve most likely been sent to jail, but avoided incarceration by pleading guilty to conspiring to commit copyright infringement. He collects a $2,000 fine.</p>
<p><img src="http://torrentfreak.com//images/absolut-warez.jpg" align="right" alt="Warez" />Back in April this year, we <a href="http://torrentfreak.com/warez-scene-members-facing-5-years-in-prison-080403/">reported</a> that five men were arrested in connection with the operation of &#8216;warez&#8217; scene servers known as TEN (The Ether Net), TBR (The Boxer Rebellion) and NRH (Nite Ranger Hideout).</p>
<p>The men were snared as part of ‘Operation Higher Education’ - a component of ‘Operation Fastlink‘ - and charged with conspiracy to commit criminal copyright infringement. Dominic Tymorek, a 53 year-old from Woodstock, Georgia, and 57 year-old Robert Hardick, of Getzville, N.Y., faced three counts. Steven Fiatarone, a 55 year-old from Spring Hill, Florida and 43-year-old Michael Uszakow, of Oakdale, Minn., faced two counts and William Parrott, of Roanoke Rapids, N.C., faced one count.</p>
<p>Previously, 57 year-old Robert Hardick, known as &#8216;tcut&#8217;, was found guilty of helping to run the &#8216;TEN&#8217; and &#8216;TBR&#8217; servers and was facing a five year prison sentence and huge fine. However, Hardick agreed to plead guilty to one count of conspiracy, and as a result picked up three years probation instead, which included 6 months of home confinement.</p>
<p>Steven Fiatarone of Spring Hill, Florida, also faced a harsh sentence of 5 years in jail and a $250,000 fine. However, he pleaded guilty on July 8th this year to one count of conspiracy, making a similar deal to Hardwick in return for a more lenient sentence.</p>
<p>On Thursday, Fiatarone appeared in the U.S. District Court for Connecticut, for his offenses linked to his operation of the warez server known as NRH (Nite Ranger Hideout), which was actually located in a school in Emporia, Virginia. Fiatarone, also known as &#8216;kidzap&#8217;, setup the server in 2001 and was alleged to have uploaded over 23,000 files and downloaded more than 40,000 in his role as administrator of NRH during 2002 and 2003.</p>
<p>Senior United States District Judge Ellen Bree Burns sentenced Fiataroine to three years of probation for conspiring to commit criminal copyright infringement, with the addition of a $2,000 fine.</p>

            <title>Ubisoft Steals ‘No-CD Crack’ to Fix Rainbox 6: Vegas 2</title>

            <description><![CDATA[<p>“Piracy is BAD” proclaims every copyright dependent industry lobby group. “Downloading is stealing” is another popular one. How about “downloads are a lost sale”? Ubisoft clearly didn&#8217;t believe that last one, as they distributed a no-cd patch from the scene group RELOADED as a fix for one of their games.</p>
<p>Piracy can be a funny business at times, but the rhetoric is often extremely predictable. So when something unexpected happens it can knock you off your stride. Something like&#8230; a major game publisher distributing a Scene no-cd crack as a fix would do it, for instance. If it sounds unlikely,  that&#8217;s because sometimes truth is stranger than fiction. In this case, the publisher is Ubisoft, the game &#8216;<a href="http://rainbowsixgame.us.ubi.com/agegate.php?destURL=/home.php" target="_blank">Rainbow Six: Vegas 2</a>&#8216;, and the <a href="http://en.wikipedia.org/wiki/The_Scene" target="_blank">Scene</a> &#8216;no-cd&#8217; crack – yes that&#8217;s there as well.</p>
<p>The situation revolves around that oddest of characters, <a href="http://www.direct2drive.com" target="_blank">Direct2Drive</a> (D2D) - an online games store, owned by IGN, selling games over the Internet as protected downloads. Game code is modified to prevent the standard retail DRM from inhibiting game play (as there is no actual disc to check for) with <a href="http://www.trymedia.com/services/security.shtml" target="_blank">Trymedia activation</a> utilized instead. More importantly, since the code around the DRM has been modified and changed to a different system, regular patches from the game developers can&#8217;t be used. Instead, patches must be reworked by D2D to accommodate these changes. These changes are not always quick, a point D2D does try and defuse in its <a href="http://support.direct2drive.com/ics/support/KBAnswer.asp?questionID=1292" target="_blank">FAQ</a>.</p>
<p>Thus we come to Rainbow Six: Vegas2 (R6V2) which, since its release in March, has had three patches released for it. The third, <a href="http://forums.ubi.com/eve/forums/a/tpc/f/1991064316/m/5371065076" target="_blank">1.03</a> provides a lot of changes, including new play modes, so legitimate purchasers of the game were eager to try it. The problem is, those that bought it via D2D can&#8217;t use it. This is the problem inherent in DRM. Those that buy the product are the ones affected, not those the DRM is designed to defeat.</p>
<p>After lots of complaining and attempts to fix things themselves, one Ubisoft employee found a solution. A zip file was uploaded to the help/support site, named “R6Vegas2_fix.zip”.

<p>If D2D users patched to 1.02, then replaced the EXE with this one, they could then update to the new patch. However, someone ran a hex edit and it appears the fix was not Ubisoft code but actually a &#8216;no-cd&#8217; crack released by the <a href="http://www.nfohump.com/index.php?switchto=nfos&amp;menu=quicknav&amp;item=viewnfo&amp;id=123261" target="_blank">Scene</a> group RELOADED, as shown here.</p>
<p>Since then, the zip file containing the fix has been pulled from the Ubisoft support site, so we&#8217;re unable to verify. The game&#8217;s community is as baffled by this as everyone else. Since the claimed origin of the fix, 10 days ago, there has been no word on it officially from Ubisoft, beyond a &#8216;Community Manager&#8217; who <a href="http://forums.ubi.com/eve/forums/a/tpc/f/1991064316/m/1381029176?r=8971050276#8971050276" target="_blank">states</a></p>
<blockquote><p>We&#8217;re looking into this further as this was not the UK Support team that posted this, however if it is an executable that does not need the disc I doubt it has come from an external source. There&#8217;d be very little point doing so when we already own the original unprotected executable.</p>

<p>Although it is not unknown for a Scene release to be used to &#8216;fix&#8217; a retail product, it&#8217;s certainly rare to have that fact promoted. That the &#8216;no-cd&#8217; patch works, might have some relation to how brutal the Scene is when it comes to the quality of their work, especially in games. Whilst this is a validation that the Scene isn&#8217;t as bad as the lobby groups would have you believe (they fixed the game, and did it for free) you can bet that Ubisoft won&#8217;t be smiling at E3, and that they, and Direct2Drive, will continue to use DRM to <a href="http://www.gamespot.com/news/6147655.html" target="_blank">annoy</a> and inconvenience paying customers.</p>

            <title>SceneAccess and NFOrce Under Pressure from BREIN</title>

            <description><![CDATA[<div><p><img src="http://torrentfreak.com/images/brein.jpg" align="right" alt="brein" />Anyone with an interest in BitTorrent sites will tell you that many of them are hosted in the Netherlands, due to what is perceived by many as a legal gray area. Dozens of sites inhabit the servers at hosts such as <a href="http://torrentfreak.com/forced-exodus-of-bittorrent-sites-071122/">LeaseWeb</a>, despite a few being kicked out or forced to move to other countries in recent months.</p>
<p>Known by most for its scene &#8216;warez&#8217; release database hosted at <a href="http://www.nforce.nl/index.php">NFOrce.NL</a>, another major torrent site host is NFOrce, which gained mainstream notoriety after the OiNK tracker was <a href="http://torrentfreak.com/oinkcd-servers-raided-admin-arrested/">busted</a> while being hosted by the company. Now it seems that anti-piracy outfit BREIN - who received press this week for their announced <a href="http://torrentfreak.com/mininova-faces-legal-action-filter-or-else-080519/">legal action</a> against BitTorrent giant mininova - has NFOrce and sites hosted there, firmly in its spotlight.</p>
<p>A few weeks ago NFOrce was approached by BREIN, who demanded the host to shut down SceneAccess and hand over the identity of the site administrator. Initially, NFOrce did not respond to these demands, so in response, BREIN filed a preliminary injunction. Soon after this announcement SceneAccess mysteriously went down, with NFOrce claiming this was due to unpaid bills.</p>
<p>Despite the fact that SceneAccess had moved to a new host outside The Netherlands, BREIN did not back off, and still demanded the customer information. Now, just days before the court hearing, NFOrce handed over the name and address information for the owner of SceneAccess which, luckily for them, turned out to be false. </p>
<p>The court case scheduled for today has now been canceled. BREIN claims that there are still owed costs relating to the case, but nonetheless, they are happy that their tactics of host-threatening are working, as other sites - and there are many of them - are said to be leaving NFOrce.</p>
<p>BREIN director Tim Kuik says that they don&#8217;t want hosts such as NFOrce &#8220;to be a safe haven for sites and servers that illegally offer movies, music, games and other interactive software”, whilst omitting to mention that BitTorrent sites host no infringing material. Going on to expand on the scope of operations, Kuik says: “These include bittorrent sites, edonkey, ftp servers and servers that carry out illegal activities. It is not the technology [at fault] but what those sites and servers do with that technology. If that is unlawful or invasive than we take action. The hosting provider will be asked to take the site or server offline, and tell us who their customer is.”</p>
<p>BREIN would like to hold hosts liable for on-going damages if they keep torrent sites running, when it becomes clear they are in possession of false contact details. NFOrce was encouraged to provide additional information which would help in the tracking down the owner of SceneAccess and hand it to BREIN, which it did. This information is still being checked, but will likely lead BREIN into another dead end, especially if the tone of the SceneAccess owner is taken into consideration:</p>
<p>&#8220;Well as some of you already know, BREIN threatened our host (NFOrce), and we had to move. We are currently on a temporary server, we will move to a new server (in a safe location) in the next few days. There’s nothing to worry about, our database server wasn’t on NFOrce, and we securely deleted (38 passes) all files from nforce before we left. We might have some downtime at some point (because of the move from the temp server to the new server) but keep seeding because, we are not going anywhere&#8221;</p>
<p>After the initial panic and worry of pending legal action, champagne bottles will probably be metaphorically cracked open but sadly for them, BREIN won&#8217;t be getting drunk, at least not in celebration. SceneAccess is no longer hosted in the Netherlands, so BREIN can be congratulated for changing the location of the server, but without affecting the operational capability of the site - or identifying the owner.</p>
