Back then, the RIAA was considered "The Big Five"  Today, they are more like the "Big Four" with a possibility of being considered the "Big Three" if Sony and BMG ever become more than a joint venture or if EMI convinces regulators that selling the company to one of the remaining won't harm competition in the market place (for some, a concept difficult to explain with a straight face)

            <title>Record Label ‘Infringes’ Own Copyright, Site Pulled</title>

            <description><![CDATA[<p>The website of a record label which offers completely free music downloads has been taken down by its host for copyright infringement, even though it only offers its own music. Quote Unquote Records calls itself &#8220;The First Ever Donation Based Record Label&#8221;, but is currently homeless after its host pulled the plug.</p>
<p><img src="http://torrentfreak.com/images/quoteunquote.jpg" align="right" alt="QuoteUnquote" /><a href="http://en.wikipedia.org/wiki/Quote_Unquote_Records">Quote Unquote Records</a> is an Internet based record label, run by <a href="http://en.wikipedia.org/wiki/Bomb_the_Music_Industry!">Bomb the Music Industry</a>! and &#8216;The Arrogant Sons of Bitches&#8217; frontman Jeff Rosenstock. A forward looking outfit, all artists on the label give their music away for free on the label&#8217;s <a href="http://www.quoteunquoterecords.com">website</a>. Well, they would, if the webhost hadn&#8217;t have taken down the site for alleged copyright infringement.</p>
<p>In a MySpace blog entry, Jeff Rosenstock <a href="http://blogs.myspace.com/index.cfm?fuseaction=blog.view&amp;friendID=85036965&amp;blogID=441944198">explained</a> that the Quote Unquote Records site is non-operational, and other sites connected to the label, including the Bomb the Music Industry! and <a href="http://www.asobrock.com/">Arrogant Sons of Bitches</a> sites, have all been taken down too. So what happened?</p>
<p>Around a week ago, the label was notified by its webhost that it had some copyright music files on its server, which was no surprise to them since they were tracks by Arrogant Sons of Bitches, one of the label&#8217;s bands. The tracks the webhost referred to were actually written by Jeff himself. Jeff spoke with someone at the host on the telephone, explained that they were his own tracks and was informed this wasn&#8217;t a problem. </p>
<p>Three days later the labels site went down completely, due to Jeff hosting his own copyright files on his own site - a claimed violation of the hosting company&#8217;s Terms of Service. In order to solve the problem, Jeff would have to send his copyright registration forms to the host by mail, to prove he held the copyright, a problem in itself, explains Jeff:</p>
<p>&#8220;I called the company to explain that a lot of this material was NOT in fact registered with the US copyright office, instead we did the ol&#8217; poor man&#8217;s copyright. The music that was copyrighted was done so under a Creative Commons License, which is a digital copyright that cannot be viewed if the website where the files are posted is down.&#8221;</p>
<p>It seems amazing that a host should be proactive like this, especially since it has clearly made a huge mistake. However, a week later and Jeff&#8217;s site is still down and he&#8217;s quite rightly upset: &#8220;I guess the scary thing for me is that it seems that my hosting server employs a guilty before proven innocent policy, which is terrifying for anyone who does not physically mail forms for every small idea they&#8217;ve ever had in their bedroom to the US copyright office. What a great new digital age, stuck in the trappings of wasteful forms and red tape.&#8221;</p>
<p>If losing your site to a bogus copyright claim isn&#8217;t enough, there is a more immediate problem. Jeff is being denied access to his data by the host and he says that since he had a crash on his local hard drive, he no longer has copies of any of the content that was on the Quote Unquote Records server. &#8220;So, long story short, I&#8217;m looking for any artwork or mp3s that were put on Quote Unquote Records,&#8221; he said.</p>

            <description><![CDATA[<p>The music industry is changing. While the record labels are desperately trying to protect the revenue stream from album sales, a new generation of artists is starting to realize that they are better off when they give away their music for free. By now, we&#8217;re all familiar with the industry&#8217;s view, but what drives these artists?</p>
<p><img src="http://torrentfreak.com/images/whatcd1.jpg" title="The What CD" align="right" alt="the pragmatic circles" />Giving away music for free might not sound like a very solid business model to most people, but it is. Most artists make most money from concerts and merchandise, not so much album sales. Even more so, the key to success are the fans, and what better way to introduce people to your music by giving it away for free?</p>
<p>A whole new generation of artists, most of who grew up with Napster, Limewire and BitTorrent, are starting to utilize the power of filesharing networks. This year alone, thousands of albums were released online for free, and this number is growing at an increasing rate. The possibilities are endless. Some artists use sites like Jamendo, others go for mainstream BitTorrent sites like The Pirate Bay and Mininova, and yet another group prefers niche BitTorrent communities such as What.cd.</p>
<p>On What.cd, one of the larger music communities with over 60,000 members, artists have found a particularly successful outlet. In fact, the free albums are particularly popular, and often among the most downloaded. The music minded members, of which quite a few are artists themselves, are very appreciative of  every new album. This August a compilation CD was released with tracks from 19 artists who uploaded their music to the site. This CD, titled &#8220;The What CD&#8221; is the most active torrent of all time on the tracker.</p>
<p>At TorrentFreak we have now reached a point where we can no longer mention all the artists that give away their music for free. <img src="http://torrentfreak.com/images/circlesart.jpg" align="left" title="Circles" alt="the what cd" />While it was a rather exceptional thing to do three years ago, it has become mainstream today. It is, however, worth talking to one of these new generation of bands and artists who decide to share their music at no cost.</p>
<p><a href="http://www.thepragmatic.com/">The Pragmatic</a> is such a band. Today, the 5 member band, which was founded in 2006, has released the album &#8216;Circles&#8217; <a href="http://www.mininova.org/tor/1903983">on BitTorrent</a> and Rapidshare. André, one of the band members, who plays an analog synthesizer from the early 80s, explained to us why they chose to give away their music for free.</p>
<p>&#8220;With this first release we really wanted to try out giving it out for free and just see what happens,&#8221; he said. &#8220;Bands like Radiohead and NIN come out and release stuff for free and have success, but that&#8217;s largely because of their already established careers. They&#8217;ve built that up the traditional way and they&#8217;ve reaped the rewards of that, but their success in file-sharing is more of a perk of that status.&#8221;</p>
<p>&#8220;Growing up, every musician dreamed of that big shiny record deal, but I don&#8217;t think it&#8217;s relevant anymore. Labels have had to sober up and re-think what their roles are. It used to be about music, and I think file-sharing has brought that to their attention. By releasing it for free, I guess we could be losing money, but in the long run I think we&#8217;re (hopefully) making fans.&#8221;</p>
<p>Similar to most other people, André is part of a generation that grew up with file-sharing. It is part of the music industry now, and it exposes people to more music than they would ever hear on mainstream radio. It is probably not what the RIAA wants to hear, or will ever admit, but music is more popular than ever thanks to file-sharing. André agrees, and told TorrentFreak:</p>
<p>&#8220;Fans go to shows, buy merch and support bands for all the right reasons. I think that our generation grew up with an almost insatiable need for more and more music. I know I did. I&#8217;ve downloaded lots of albums I loved and bought physical versions. I&#8217;ve downloaded plenty of albums I hated and deleted. I can&#8217;t begin to count how many bands I know and love because of Napster/Soulseek/Bittorrent. File-sharing was never really about stealing music, it was about finding music you loved.&#8221;</p>
<p>&#8220;Labels will complain and sue their very core audience just to make a dollar. I can&#8217;t blame them, it&#8217;s the way they&#8217;ve built their company. Change scares them, especially when they don&#8217;t control it. I honestly believe that I wouldn&#8217;t be a musician today if Napster hadn&#8217;t appeared. I think Napster fostered the incredible current musical culture and nobody gives them credit for it. I find it very hard for an upcoming artist to get any exposure without being willing to promote their music on p2p networks.&#8221;</p>
<p>The clash between artist and labels, and the ever increasing piracy statistics are forcing the big labels to rethink their business models. Nowadays, BitTorrent has the power to promote artists based on their music, not on the advertising budget. It is hard to deny that the music labels are in a crisis, however, music itself is more alive than ever before.</p>

            <description><![CDATA[In light of major music stores selling DRM encoded music collapsing, Nokia apparently thinks that they can somehow reverse the trend and make a successful business model out of it.  Clearly a large responsible company that knows technology would know how to bring this kind of model to success where tiny little not-too-bright upstart companies like Yahoo! and Microsoft failed.

Let's pause for a moment and think about this.  If you are a smart entrepreneur looking for some way to bring into existence a strong successful company, what would be one of two things you would try?  One might be to think of a business model that doesn't exist yet that would potentially have a large demand.  The other might be to start a company that follows similarly along the lines of an already existing business model, yet somehow provide healthy competition to compete in an expanding market place.

In a move not seen since the launch of the Stephen Page founded Canadian Music Creators Coalition, a new coalition known as the Featured Artists Coalition has launched.

“It is time for artists to have a strong collective voice to stand up for their interests. The digital landscape is changing fast and new deals are being struck all the time," said Brian Message, co-manager of Radiohead and Kate Nash said in the coalitions first press release, "but all too often without reference to the people who actually make the music. Just look at the recent MoU on file-sharing between labels, government and the ISPs.

Napster has had quite a run with the media and Napster 2.0 seemed to make the headlines on a fairly regular basis with it's supposedly revolutionary business model of a subscription service for an unlimited archive of music encoded with Digital Rights Management.  Things were going well for the company back in 2005 with backing of the major record labels and an influx of subscribers willing to buy in.

While the company capitalized on their gains with glamorous press releases and places in major news outlets over their successes and gains, their losses were kept rather quiet - typical for a company that relies on image to help with their business.

            <description><![CDATA[<p>Metallica&#8217;s label Universal stepped in and canceled an interview with a Swedish newspaper last week after one of its writer reviewers said he got his copy via BitTorrent. The writer,  Jonn Jeppsson, who actually reviewed an edited version of the album, admitted he downloaded it from The Pirate Bay.</p>
<p><img src="http://torrentfreak.com/images/deathmagnetic.jpg" align="right" alt="deathmagnetic" />It seems that no matter how hard they try, Metallica will continue to make anti-piracy headlines. After their bloody battle with Napster years ago, they were determined to keep calm when their latest album, &#8216;Death Magnetic&#8217;, inevitably hit the torrents. </p>
<p>This time, Metallica&#8217;s Lars Ulrich shocked everyone by <a href="http://news.bbc.co.uk/2/hi/entertainment/7598617.stm">saying</a>: &#8220;If this thing leaks all over the world today or tomorrow, happy days. It&#8217;s 2008 and it&#8217;s part of how it is these days.&#8221;</p>
<p>Despite this effort, it hasn&#8217;t taken long before people are arguing over piracy. According to a report, Metallica&#8217;s label, Universal Music, canceled an interview the band had planned with the Swedish newspaper Sydsvenskan last week, after a writer there, Jonn Jeppsson, sparked off an anti-piracy row featuring him and The Pirate Bay.</p>
<p>Instead of reviewing the official version of the album, Jeppsson used an <a href="http://www.metalsucks.net/?p=7259">unauthorized cut</a> called &#8220;Death Magnetic: Better, Shorter, Cut&#8221;, which contains the same songs as the original, but shortened. If reviewing an unofficial copy wasn&#8217;t enough, Mr Jeppson clearly enraged Universal when he admitted in his review that he downloaded his copy off The Pirate Bay. </p>
<p>Metallica&#8217;s label Universal was not pleased, to say the least. Talking with Dagens Media, Universal Sweden&#8217;s Per Sundin <a href="http://www.dn.se/DNet/jsp/polopoly.jsp?d=2374&amp;a=827369">said</a>: &#8220;The reviewer is referring to a torrent where someone has altered the original songs. The reviewer explains exactly where one should go in order to download the file that is totally infringing copyright. It&#8217;s not only an illegal file, but an altered file. The reviewer also writes that this is how the album should have sounded.&#8221; </p>
<p>Showing that Universal isn&#8217;t happy about piracy, even if Lars seems to have undergone a road-to-Damascus-style recovery, Sundin went on stating: &#8220;File-sharing of music is illegal. Period. There&#8217;s nothing to discuss. That fact that Sydsvenskan has a writer that has downloaded this music illegally and then makes mention of an illegal site in his review is totally unacceptable to us.”</p>
<p>Hinting that Universal may stop sending promo material for Sydsvenskan to review he ends: &#8220;We live in symbiosis with each other and we send them our artists&#8217; record for free for review. But if they download the albums illegally instead, then there&#8217;s no point in doing that.&#8221;</p>
<p>Meanwhile, &#8216;Death Magnetic&#8217; entered the <a href="http://www.bbc.co.uk/radio1/chart/albums.shtml">UK chart</a> at #1.</p>
